ORDINANCE NO. 2010- 4 6 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE <br />FUTURE LAND USE MAP FROM "C" COMMERCIAL TO "MDR" <br />MEDIUM DENSITY RESIDENTIAL FOR A 9.90 ACRE, MORE OR <br />LESS, TRACT OF LAND OUT OF THE J.M. VERAMENDI SURVEY <br />NO.2, ABSTRACT NO. 17, LOCATED APPROXIMATELY 600 FEET <br />WEST OF THE 1900 BLOCK OF NORTH 1H -35 AND 200 FEET <br />NORTH OF THE MILL STREET EXTENSION; AMENDING THE <br />OFFICIAL ZONING MAP OF THE CITY BY REZONING THIS <br />TRACT FROM "GC" GENERAL COMMERCIAL DISTRICT TO "MF- <br />12" MULTIPLE - FAMILY RESIDENTIAL DISTRICT; AND <br />INCLUDING PROCEDURAL PROVISIONS <br />RECITALS: <br />1. On July 13, 2010, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the Future Land Use Map of the San Marcos <br />Horizons City Master Plan from "C" Commercial to "MDR" Medium Density Residential, and a <br />concurrent request to change the zoning from "GC" General Commercial District to "MF -12" <br />Multiple - Family Residential District, for a 9.90 acre, more or less, tract of land located <br />approximately 600 feet west of the 1900 Block of North IH -35 and 200 feet north of the Mill <br />Street extension. <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests on July 13, 2010, and recommended that the <br />requests be approved by the City Council of the City. <br />3. The City Council held a public hearing on August 17, 2010 regarding the requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation for the following real property from "C" <br />Commercial to "MDR" Medium Density Residential: <br />Street address: Approximately 600 feet west of the 1900 block of North IH -35 and 200 <br />
