if authorization has been obtained from the City Council, and a performance bond for such improvements from the contractor, with the City as a co- obligee; (5) Provisions for securing the obligations of the agreement consistent with Section 1.6.6.4; and (6) Such other terms and conditions as are agreed to by the property owner and City, or as may be required by this Land Development Code. SECTION 4. Section 1.6.6.6, Maintenance and Warranty of Improvements, subsection (b), is amended to read as follows: (b) Bond. The owner shall covenant to warranty the required public improvements for a period of one year following acceptance by the City of all required public improvements and shall provide a maintenance bond in the amount of 20 4-00percent of the costs of the improvements for such period. All improvements located within an easement or right -of -way shall be bonded. SECTION 5. Chapter 4, Article 1, Division 6, Dimensional and Development Standards, Section 4.1.6.1, General, is amended by amending Table 4.1.6.1 as shown in Exhibit "A ", attached hereto and made a part hereof. SECTION 6. Section 4.3.1.2, Land Use Matrix, is amended in accordance with the revisions shown in the table attached hereto as Exhibit `B" and made a part hereof, together with the inclusion of the following original heading and original legend which legend shall be incorporated into the Matrix at the top of the Matrix: Section 4.3.1.2 Land Use Matrix LEGEND P - The land use is permitted by right in the zoning district indicated. - The land use is prohibited in the zoning district indicated (Blank). C - The land use may be approved as a Conditional Use Permit (CUP) in the zoning district indicated. SECTION 7. Section 4.5.3.7, Special Exceptions for Nonconforming Uses and Structures, subsection (b), is amended to read as follows: (b) The ZBOA may grant special exceptions for the following: (1) Interpret the provisions of this Chapter in a way so as to carry out the intent and purpose of this Chapter, adjust districts where the street layout actually on the ground varies from the street layout as shown on the maps.
