if authorization has been obtained from the City Council, and a <br />performance bond for such improvements from the contractor, with the <br />City as a co- obligee; <br />(5) Provisions for securing the obligations of the agreement consistent with <br />Section 1.6.6.4; and <br />(6) Such other terms and conditions as are agreed to by the property owner <br />and City, or as may be required by this Land Development Code. <br />SECTION 4. Section 1.6.6.6, Maintenance and Warranty of Improvements, subsection <br />(b), is amended to read as follows: <br />(b) Bond. The owner shall covenant to warranty the required public <br />improvements for a period of one year following acceptance by the City of all required <br />public improvements and shall provide a maintenance bond in the amount of 20 <br />4-00percent of the costs of the improvements for such period. All improvements located <br />within an easement or right -of -way shall be bonded. <br />SECTION 5. Chapter 4, Article 1, Division 6, Dimensional and Development <br />Standards, Section 4.1.6.1, General, is amended by amending Table 4.1.6.1 as shown in Exhibit <br />"A ", attached hereto and made a part hereof. <br />SECTION 6. Section 4.3.1.2, Land Use Matrix, is amended in accordance with the <br />revisions shown in the table attached hereto as Exhibit `B" and made a part hereof, together with <br />the inclusion of the following original heading and original legend which legend shall be <br />incorporated into the Matrix at the top of the Matrix: <br />Section 4.3.1.2 Land Use Matrix <br />LEGEND <br />P - The land use is permitted by right in the zoning district indicated. <br />- The land use is prohibited in the zoning district indicated (Blank). <br />C - The land use may be approved as a Conditional Use Permit (CUP) in the <br />zoning district indicated. <br />SECTION 7. Section 4.5.3.7, Special Exceptions for Nonconforming Uses and <br />Structures, subsection (b), is amended to read as follows: <br />(b) The ZBOA may grant special exceptions for the following: <br />(1) Interpret the provisions of this Chapter in a way so as to carry out the <br />intent and purpose of this Chapter, adjust districts where the street layout <br />actually on the ground varies from the street layout as shown on the maps. <br />
