Subaward and /or Contract to a Federal Agency. <br />The Recipient, subrecipient, contractor and /or subcontractor shall not subgrant or subcontract <br />any part of the approved Project to any agency or employee of DOC or other federal <br />department, agency, or instrumentality without the prior written approval of the Grants Officer. <br />Requests for approval of such action must be submitted to the Project Officer who shall review <br />and make a recommendation to the Grants Officer. The Grants Officer shall make the final <br />determination and will notify the Recipient in writing of the final determination. <br />7. EDA Contracting Provisions for Construction Projects. The Recipient shall use the <br />"EDA Contracting Provisions for Construction Projects" as guidance in developing all <br />construction contracts. The "EDA Contracting Provisions for Construction Projects" lists <br />applicable EDA and other federal requirements for construction contracts. <br />M. Property. <br />Standards. With respect to any property acquired or improved in whole or in part with EDA <br />investment assistance under this Award, the Recipient shall comply with the property <br />management standards found in EDA's regulations at 13 C.F.R. part 314. Property acquired or <br />improved in whole or in part by the Recipient under this Award may consist of real personal <br />property, including intangible property such as money, notes, and security interests. Any <br />inventory listings stipulated under the applicable uniform administrative requirements must be <br />submitted to the Grants Officer on Form CD -281, "Report of Government Property in <br />Possession of Contractor." <br />2. Retention of Title. <br />a. The Government shall determine who retains title to all nonexpendable personal property <br />in accordance with 15 C.F.R. parts 14 or 24, as applicable. Use, management, and the <br />disposition of such property will be in accordance with the requirements set out at <br />15 C.F.R. parts 14 or 24, as applicable, and EDA's regulations at 13 C.F.R. part 314. <br />b. Title to real property (whether acquired partly or wholly with federal funds) will vest with <br />the Recipient subject to the condition that the Recipient uses the real property for the <br />authorized purpose of the Project. <br />EDA's Interest in Award Property. <br />a. Evidence of Title. Prior to the advertisement of bids or at such other time as EDA requires, <br />the Recipient must furnish evidence, satisfactory in form or substance to the Government, <br />that title to real property required for the Project (other than property of the United States <br />25 <br />
