If additional information is required <br />during the period of the Award, funds can be withheld by the Grants Officer under a special <br />award condition requiring the Recipient to submit additional environmental compliance <br />information sufficient to enable EDA to make an assessment on any impacts that the Project <br />may have on the environment. <br />2. Environmental Quality Improvement Act of 1970, as amended (42 U.S.C. <br />§§ 4371— 4375) <br />Federally- supported public works facilities and activities that affect the environment shall be <br />implemented in compliance with policies established under existing law. <br />3. Executive Order 12088, "Federal Compliance with Pollution Control Standards," <br />(43 Fed. Reg. 47707, October 13, 1978), as amended <br />All necessary actions shall be taken for the prevention, control, and abatement of <br />environmental pollution with respect to federally- supported facilities and activities <br />4. Executive Order 11514, "Protection and Enhancement of Environmental Quality," <br />(35 Fed. Reg. 4247, March 5, 1970), as amended <br />Federally- supported facilities and activities shall be maintained and directed to meet national <br />environmental goals. <br />5. Executive Order 11593, "Protection and Enhancement of the Cultural Environment," <br />(36 Fed. Reg. 8921, May 13,1971), as amended <br />Federally -owned sites, structures, and objects of historical, architectural, or archaeological <br />significance shall be preserved, restored, and maintained. <br />6. Clean Air Act, Clean Water Act, and Executive Order 11738 <br />Recipients must comply with the provisions of the Clean Air Act (42 U.S.C. § 7401 et seq.), <br />the Clean Water Act (42 U.S.C. § 1251 et seq.), and Executive Order 11738, and shall not use <br />a facility on the Environmental Protection Agency's ( "EPA") List of Violating Facilities in <br />performing any Award that is nonexempt under 2 C.F.R. § 1532, and shall notify the EDA <br />Project Officer in writing if it intends to use a facility that is on EPA's List of Violating <br />Facilities or knows that the facility has been recommended to be placed on the List. <br />7. The Safe Drinking Water Act of 1974, as amended (42 U.S.C. § 300f et seq.) <br />This Act precludes federal assistance for any project that the EPA determines may <br />contaminate a sole source aquifer so as to threaten public health. <br />8. Executive Order 11988, "Floodplain Management," (42 Fed. Reg. 26951, May 24,1977) <br />and Executive Order 11990, "Protection of Wetlands," (42 Fed. Reg. 26961, <br />May 24, 1977) <br />Recipients must identify proposed actions in federally - defined floodplains and wetlands to <br />enable the agency to make a determination whether there is an alternative to minimize any <br />potential harm. <br />9. The Flood Disaster Protection Act of 1973, as amended (42 U.S.C. § 4002 et seq.), and <br />regulations and guidelines issued thereunder by the U.S. Federal Emergency <br />Management Administration ("FEMA") or by EDA <br />Flood insurance, when available, is required for federally- assisted construction or acquisition <br />in flood -prone areas. <br />29 <br />
