(o) Enforcement. <br />(1) The city shall have the power to administer and enforce the provisions of this Chapter as <br />may be required by governing law. Any person, firm, corporation or agent who shall violate a <br />provision of this code, or fails to comply therewith, or with any of the requirements thereof, is <br />subject to suit for injunctive relief as well as prosecution for criminal violations. Any knowing <br />violation of the elements of this ordinance as codified in the San Marcos Code is declared to be a <br />nuisance. <br />(2) The city water purveyor can suspend utility service for any violation of this article. <br />(3) Any person who knowingly violates any provision of this section shall, upon conviction, be <br />fined a sum as provided in Chapter 1, Section 1.015(a) of the San Marcos Code. . <br />(4) An offense under this section is a Class C misdemeanor. <br />(5) Nothing in this section shall be construed as a waiver of the city's right to bring a civil <br />action to enforce the provisions of this section, or any other building code violation, and to seek <br />remedies as allowed by law, including, but not limited to the following: <br />a. Injunctive relief to prevent specific conduct that violates the ordinance or to require specific <br />conduct that is necessary for compliance with the ordinance; and <br />b. Other available relief. <br />(6) Whenever a corporation or association violates any provision of this section, the president, <br />vice - president, secretary, treasurer, manager or any agent or employee of the corporation or <br />association who is responsible for the violation shall be subject to the penalty prescribed for the <br />violation. <br />(p) Fees. The city council, by separate ordinance, may create a schedule of fees for obtaining <br />and renewing an irrigation permit. These fees will be in amounts sufficient to cover the city's <br />costs in issuing and renewing the permits, including, but not limited to, staff time and other <br />costs. <br />Secs. 14.127 -- 14.130.
