Such policies shall be non - discriminatory and in <br />conformity with Chapter 10 of the San Marcos City Code. <br />3.1.5 Develop and recommend to City Manager: <br />(1) Access and Security Plans for both airside and landside areas of the Airport including <br />perimeter security, facilities security, parking lot security and disaster security on the <br />Airport, exclusive however, of law enforcement responsibilities. The Operator will <br />report breaches in security and threats of such breaches to the City Manager and the San <br />Marcos Police Department immediately upon discovery. The Operator will conduct an <br />annual review of the Airport's security with the City to identify areas of risk and <br />measures for improving security. In addition, the Operator will develop and maintain <br />Airport emergency plans in cooperation with the City's Police and Fire Departments for <br />all Airport related emergencies. The Operator may change the locks and/or security <br />codes on any or all of the maintenance facilities and equipment; provided a duplicate key <br />and/or security codes for all changed locks will be promptly provided to the City. All <br />keys and/or security codes will be identified by tag or location. <br />(2) Signage Plan in accordance with the City's sign ordinance. <br />(3) Comprehensive Safety Program <br />(4) Operating Plan. On or before January 1 of each year during the term of this Agreement <br />Operator shall submit in writing to the City Manager for the City's review and consider <br />of approval, an Operating Plan for the Airport for the fiscal year following the date of the <br />submission. The Operating Plan shall include: (i) the Operator's prudent assessment and <br />analysis of the Upkeep reasonably needed at the Airport for the next fiscal year; (ii) a <br />maintenance and repair schedule; (iii) a schedule of proposed Airport fees; (iv) a list of <br />all concessionaires, contractors and tenants; (v) schedule of all leases, concessions, <br />contracts and agreements to be negotiated or renegotiated; (vi) recommendation, if any, <br />for non - capital improvements of Airport facilities and acquisition of equipment; (vii) a <br />three (3) year projection of anticipated revenues and expenses; and (viii) a schedule of <br />proposed staffing levels of full, part -time, and seasonal employees. Appropriate <br />modifications of the Airport Operating Plan shall be made as required to conform to the <br />Approved Operating Budget and City's Capital Improvements Plan ( "CIP ") as adopted or <br />amended. Operator shall manage and operate the Airport in accordance with the <br />Operating Plan approved by the City. <br />(5) Lease Plan. Operator shall, on or before January lst of each year during the term of this <br />Agreement provide to the City for its review and consideration of approval an Airport <br />lease renewal and extension plan for the fiscal year following the date of submission. <br />11 <br />
