Leases /Agreements <br />3.1.28 Operator shall solicit and negotiate leases and other agreements for existing <br />Airport facilities (including all ground leases, hangar leases, building leases and <br />through- the -fence agreements) for all leasable areas of the Airport (including all <br />renewals, expansions, relocations and extensions thereof collectively referred to <br />as "Lease(s) ") and to cause the Airport to be properly occupied with aviation <br />related tenants and tenants which support aviation activities. <br />3.1.29 During the transition period, Operator shall review the terms and conditions of <br />standard Airport leases, permits, licenses, and other agreements (TxDOT and <br />otherwise), and review existing leases and agreements. Based upon this review <br />Operator shall identify tenants, permittees, lessees and licensees that are <br />noncompliant and recommend a compliance plan to the City Manager. <br />3.1.30 As part of the proposed operating budget submitted annually by the Operator to <br />the City, the Operator will provide a schedule of all leases then in effect at the <br />Airport and will develop and recommend for the City's review and consideration <br />the proposed terms on which these leases might be extended, amended or renewed <br />during the coming year as well as terms on which new leases might be made. <br />3.1.31 Develop and recommend to City Manager reasonable standards for the physical <br />appearance and operating condition of third -party premises in accordance with the <br />terms and provisions of ground leases. In addition, the Operator will enforce <br />compliance with physical appearance, operating and environmental standards by <br />all Airport tenants, permit holders, lessees, and licensees (including EPA and <br />TCEQ regulations). In addition to further this requirement, the Operator will <br />provide the City with quarterly reviews of third party premises, facilities and <br />infrastructure to ensure proper maintenance (e.g., crack sealing, hole patching and <br />seal coating). <br />3.1.32 Develop and recommend to the City Manager specific plans and programs to fully <br />utilize (and increase revenues from) existing Airport facilities and properties <br />through leases or other agreements. <br />3.1.33 Prepare and submit written quarterly reports on real estate management activities <br />including but not limited to revenues and expenses, occupancy and lease rates, <br />fees and charges, leasing progress reports, including summaries of Lease <br />negotiation results; a forecast of rental and occupancy changes; recommendations <br />of items Operator believes will aid in leasing the Airport; and periodic market <br />updates, date, and information in a manner requested by City. <br />In <br />
