5.0.9 Have the exclusive authority to initiate, review and approve the exercise of all <br />powers of eminent domain regarding the Airport. <br />5.0.10 Provide access to and make all necessary provisions for the Operator to enter <br />public and private property as reasonably required for the Operator to perform its <br />services under this Agreement. <br />5.0.11 Bear all other costs incidental to this Article. <br />5.0.12 Be responsible for major repairs and maintenance. In the event of damage by fire <br />or other casualty, the City will either repair or replace building(s) or remove the <br />damage and restore building(s) to original condition at the sole option of the City. <br />5.0.13 Provide rent -free office space as reasonably determined by the City and subject to <br />space availability. <br />ARTICLE 6 <br />COMPENSATION TO THE OPERATOR <br />6.1 COMPENSATION <br />The total of all fees and expenses to be paid to the Operator for the provision of basic <br />services for the first full year of the Agreement is $285,000 as described in Sections 3.0 <br />through 3.4 broken down as follows: <br />Services Cost <br />Airport Management Fee $150,000 <br />Maintenance $ 62,500 <br />Operations $ 42,500 <br />Regulatory Agency Interface $ 15,000 <br />Marketing Services $ 15,000 <br />6.1.1 The City will pay the Operator an amount specified in the Approved Operating <br />Budget to pay for Operator's Operating Costs. Operating Costs shall be paid in <br />accordance with the annual Approved Operating Budget. No expenditure for any <br />one line item or accounting category which is in excess of the amount shown in <br />the Approved Operating Budget ( "Excess Operating Costs ") shall be paid or <br />reimbursed to Operator, except expenditures that have been approved in writing <br />by the City prior to the expenditure.
