Cosentino <br />San Marcos City Attorney <br />630 East Hopkins <br />San Marcos, Texas 78666 <br />Re: Engagement Letter concerning Mayor Susan Narvaiz. and <br />Council Member Kim Porterfield <br />Dear Mr. Cosentino: <br />This letter will confirm the retention of The O'Quinn Law Firm to provide legal <br />representation to Mayor Susan Narvaiz and Council Member Kim Porterfield. <br />Specifically, The O'Quinn Law Firm is being retained to represent Mayor Susan <br />Narvaiz and Council Member Kim Porterfield ( "Clients ") in their official capacities as <br />Mayor and Council Member of the City of San Marcos in regard to a Petition for <br />Injunctive Relief filed September 3, 2010 by a group that calls itself Citizens Advocating <br />Responsible Education — S.M.C.I.S.D. (CARE — SMCISD). <br />Our firm's representation is limited to this matter, and The O'Quinn Law Firm <br />has not been retained to represent the Mayor and Council Member in connection with any <br />other matter unless we modify this engagement letter by a subsequent letter agreement. <br />We will perform all reasonable services and take all such action as may be appropriate <br />and necessary in my professional discretion to further the interests of the City of San <br />Marcos. <br />The O'Quinn Law Firm's fee for representing the Client will be as follows: <br />Charles E. Soechting - $300.00 per hour <br />Randall Buck Wood - $300.00 per hour <br />Paralegal /Legal Assistant - $100.00 per hour <br />Our firm will invoice the City of San Marcos monthly plus reasonable expenses incurred <br />in this matter. We will provide you a detailed invoice listing those services performed as <br />well as reasonable expenses incurred. <br />It is anticipated that our fees will not exceed $15,000.00. If our fees do exceed <br />$15,000.00, that will be subject to an additional negotiated agreement. <br />Expenses include, but are not limited to, filing fees, travel expenses, expert fees, <br />photo- copies, printing, postage, delivery charges and court- reporter costs. <br />It is expressly understood that the attorney handling the litigation will be Charles <br />E.
