1.6.1 Coordinate with the City and title company to obtain an updated title commitment along <br />with other forms and a certified copy of the instrument of conveyance necessary when requesting <br />the parcel payment from the City. <br />1.6.2 Attend closings and provide closing services in conjunction with the title company. <br />1.6.3 Ensure that the title company records all original instruments immediately after closing in <br />the respective County Clerk's Office including donation agreements. The Consultant will <br />deliver an executed easement document to the City if not being provided by the title company. <br />1.7 ADDITIONAL SERVICES /CHANGE IN SERVICES <br />1.7.1 The City may direct the Consultant to perform services outside of the scope of the Basic <br />Services described in Sections 1.1 through 1.6 above. The Consultant will submit a written <br />estimate of fees to the City and obtain the City's authorization before initiating any additional <br />services. Consultant services required due to changes to any parcel including but not limited to <br />plan changes, splits of the parcel, re- appraisal, plat changes, survey changes, or other changes <br />that are required through no fault of the Consultant or are beyond the control of Consultant are <br />considered additional services. <br />1.7.2 Each material change (deletion or addition) in the services to be provided by Consultant <br />must be authorized by the City on the Authorization of Change in Services form attached to this <br />Agreement as Attachment A. Compensation for additional services will be in addition to that <br />specified for Basic Services in accordance with Article 13 of this Agreement. The approval of <br />the San Marcos City Council body is necessary for all additional services the compensation for <br />which exceeds $50,000.00. <br />ARTICLE 2 <br />THE CITY'S RESPONSIBILITIES <br />The City will: <br />2.1 Provide full information to the Consultant regarding the City's requirements for the <br />Consultant's services under this Agreement. The City will furnish the Consultant with copies of <br />data and information in the City's possession needed by the Consultant at the Consultant's <br />request. In addition, the City will provide the Consultant with accurate land descriptions <br />(including parcel plats and field notes), available information about the Projects; title information <br />and any other applicable information. For the duration of this Agreement, the City will provide <br />the Consultant with accurate and timely information regarding the details of right of way <br />acquisition offers or settlements that may be made by the Consultant, including keeping the <br />Consultant informed of any changes in the permissible terms of offers or settlements. <br />2.2 Provide limited title certificates, title services, title commitments, policies, closing and <br />escrow services through an agreement with Independence Title Company.
