ORDINANCE NO. 2010 -51 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE <br />FUTURE LAND USE MAP FROM "LDR" LOW DENSITY <br />RESIDENTIAL TO "HDR" HIGH DENSITY RESIDENTIAL FOR A <br />0.360 ACRE, MORE OR LESS, TRACT OF LAND OUT OF THE <br />THIRD DIVISION PARK ADDITION LOCATED AT 1028 <br />CHESTNUT STREET; AND INCLUDING PROCEDURAL <br />PROVISIONS <br />RECITALS: <br />1. On July 27, 2010, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the Future Land Use Map of the San Marcos <br />Horizons City Master Plan from "LDR" Low Density Residential to "HDR" High Density <br />Residential for a 0.360 acre, more or less, tract of land. <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />considered and voted to approve the request on July 27, 2010, and recommended that the request <br />be approved by the City Council of the City. <br />3. The City Council held a public hearing on September 7, 2010 regarding the request. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation for the following real property from "LDR" <br />Low Density Residential to "HDR" High Density Residential: <br />Street address: 1028 Chestnut Street <br />Size: 0.360 acres, more or less <br />Legal description: Lot 80, Third Division Park Addition, as shown in Exhibit "A ", <br />attached hereto and made a part hereof. <br />SECTION 2. After its original passage, this ordinance will be subject to reconsideration <br />at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is <br />
