MEMORANDUM OF UNDERSTANDING <br />ADVANCED LAW ENFORCEMENT I:~,~PID RESPONSE TRAINING PROJECT <br /> <br />The City of San Marcos (the "City"), Southwest Texas State Univemity ("SWT") and the County of Hays (the <br />"County") enter into this memorandum of understanding under the authority of Texas Government Code, <br />Chapter 791, as amended. This memorandum of understanding is effective as of October 1, 2002. <br /> <br /> '~. BACKGROUND AND PURPOSE <br /> 1.01. The parties have agreed to cooperate to implement and operate a project to train law enforcement <br /> officers who are the first to arrive at a scene of violence. This project is known as the Advanced <br /> Law Enforcement Rapid Response Training (ALERRT) Project. <br /> 1.02. The Project consists of two elements: <br /> <br /> a. A mobile training program to be conducted at numerous sites around the State, funded in <br /> part by a grant to the City from the Office of the Governor, Criminal Justice Division. <br /> b. The establishment of a training facility (the "Facility") on a site at the Gary Job Corps <br /> <br /> Center property near San Marcos, Texas, funded in part by a grant to SWT from the <br /> United States Department of Justice. <br /> <br />1.03. The purpose of this MOU is to generally describe the roles and responsibilities of the parties with <br /> respect to the Project. The parties agree to work cooperatively toward the goal of establishing <br /> and operating the Project efficiently. They will execute further agreements that set forth their <br /> duties and responsibilities for specific aspects of the Project. <br /> 2. GENERAL OPERATIONAL PROVISIONS <br />2.01. A Management Committee is established, consisting of the City's Chief of Police, the Chair of SWT's <br /> <br /> Criminal Justice Department, and the County's Sheriff. The Management Committee will provide <br /> policy and operational guidance for the Project. The Management Committee may make <br /> recommendations to the parties regarding amendments or addendums to this agreement. The <br /> Management Committee will meet on an as-needed basis. <br /> <br />2.02. SWT and the County agree to execute subaward agreements with the City as described in the grant <br /> application for the project element described in Paragraph 1.02a above The City and the County <br /> agree to execute subaward agreements with SWT as described in the grant application for the project <br /> element described in Paragraph 1.02b above. The parties agree to comply with the terms and <br /> conditions of their respective grant award agreements and grant subaward agreements related to <br /> these two project elements. <br /> <br />2.03 The parties agree to cooperate in submitting future applications for state and federal grant funding <br /> for continued operation of the Mobile Training Program element of the Project, and for operation, <br /> maintenance and improvements to the Training Facility element of the Project. With respect to any <br /> <br /> <br />
