Attachment 2 <br />Terms and Conditions of the Prime Award and Other Special Terms and Conditions <br /> <br />This Agreement is made as a result of the Grant No. DB-02-AI0-16386-01that was awarded to the City of San Marcos by <br />the Office of the Governor, Criminal Justice Division. The general provisions of this grant are those covered by OMB <br />Circulars No. A-21, A-110, A-122, A-128, A-133 and A-87, by tile Office of Justice Programs (OJP) Financial <br />Regulations, by the Education Department General Administrative Regulations (EDGAR), which are all incorporated by <br />reference into this Agreement. Collaborator agrees to abide by these provisions, including the appropriate administrative <br />and cost guidelines. If Collaborator is a member of the FederaI Demonstration Partnership (FDP), this Agreement shall be <br />subject to the terms and conditions of the FDP General Terms and Conditions and any agency-specific requirements. <br />Where approval is required from DOE, such approval shall be sought from the City. <br /> <br />Compliance Assurances and Certifications. Collaborator certifies, by signing this document that the following assurances <br />and certifications that apply to the City prime grant are met. Such assurances and certifications required by the <br />Collaborator shall include but are not necessarily limited to: <br /> <br />Civil Rights. Cmnpliance with Title VI of the Civil Rights Act of 1964. <br /> <br />Handicapped Individuals. Compliance with Section 504 of the Rehabilitation Act of 1973 as amended. <br /> <br />Nondiscrimination. Compliance with he Onmibus Crime Control and Safe Streets Act of 1968, as amended (42 <br />USC 3789), Title II of the Americans with Disabilities Act, as amended, the Department of Justice <br />Nondiscrinfination regulations (28 CFR Part 42, Subparts C, D, E and G), and the Department of Justice <br />regulations on disability discrimination (28 CFR Part 35 and Part 39). <br /> <br />Sex Discrimination. Compliance with Section 901 of Title D (of the Education Amendments of 1972 as <br />amended). <br /> <br />Age Discrimination. Compliance with the Age Discrimination Act of 1975 as amended. <br /> <br />Patents, Licenses, and inventions. Compliance with the Standard Patent Rights clauses as specified in 37 CFR, <br />Part 501, FAR 57.227-1 I, or U.S.C. 203, whichever is appropriate and applicable. <br /> <br />Non-Delinquency oa Federal Debt. Collaborator specifically certifies that neither it nor any person to be paid <br />from f~nds under this Agreement is delinquent in repaying any Federal debit as defined by OMB Circular A-129. <br /> <br />Drug-Free Workplace. Compliance with the Drag-Free Workplace Act of 1988, 45 CFR Part 76, Subpart F. <br /> <br />Misconduct in Science. Compliance with 42 CFR Part 50, Subpart A, and Final Rule as published at 54 CFR <br />32446, August 8, 1989. <br /> <br />Conflict of Interest. Compliance with the DOE requirement to maintain a written standard of conduct and comply <br />with 42 CFR Part 50, Subpart F. <br /> <br />Political Activity. Limitations on political activity by employees whose principal employment is in connection <br />with an activity financed in whole or in part by federal grants (5 USC 1501 et seq.). <br /> <br /> <br />
