ORDINANCE NO. 2010 -61 A ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, EXTENDING THE EXCEPTION FROM APPLICATION OF REVISED IMPACT FEES FOR RIO MARC DEVELOPMENT'S EL CAMINO REAL SUBDIVISION FROM OCTOBER 9, 2011 TO DECEMBER 31, 2015 RECITIALS: 1. On September 25, 2002, the City Council enacted an ordinance that, in part, provided for a revision of the amount of impact fees that would be paid by developers and builders for connection to the City's water and waste water facilities. 2. On December 9, 2002, the City Council enacted Ordinance No. 2002 -81 that provided for an exception from the application of the revised impact fee amounts for certain existing projects. The exception status effectively froze the old impact fees for these certain projects; however, that exception expires, for all projects, on December 31, 2007. 3. On October 16, 2007, the City Council enacted Ordinance No. 2007 -62 that extended the exception from payment of the revised impact fees until October 9, 2011 applicable only to the 154 remaining lots in El Camino Real Subdivision. 4. Rio Marc Development, Ltd. requested another extension of the exception until December 31, 2015. 4. Granting this extension is in the public interest since the houses in this subdivision fall into the affordable housing category. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The expiration of the exception to the revised amounts of the water facilities impact fee and wastewater facilities impact fees granted by Ordinance Number 2002 -81 and extended by Ordinance No. 2007 -62 is hereby further extended from October 9, 2011 to December 31, 2015 for the 154 remaining lots in the El Camino Real Subdivision. SECTION 2. This ordinance is cumulative of all other ordinances of the City, and this ordinance shall not operate to repeal or affect any of such other ordinances except as to provisions that are in conflict with the provisions of this ordinance, in which event the conflicting provisions are hereby superseded. SECTION 3. This ordinance shall be in effect upon adoption.
