152. INTERLOCAL AGREEMENT FOR ROADWAY CONSTRUCTION AND MAINTENANCE Effective Date: January 15, 2003 Parties: The City of San Marcos, hereinafter referred to as the "City," and the County of Hays, hereinafter referred to as the "County". Recitals: 1. The Interlocal Cooperation Act (Chapter 791, Texas Government Code) empowers the parties to contract with each other in the performance of governmental functions, including functions and services in the area of streets, roads and drainage. 2. The City has awarded a contract for the construction of improvements to Clovis Barker Road (the "improvements"), a portion of which are located within the City and the remainder of which are located outside the City limits, and alt of which are located within the County. 3. The County is willing to contribute funding towards the costs of the improvements for the portion of Clovis Barker Road that is outside the City limits, in exchange for the City agreeing to maintain the entire length of Clovis Barker Road, including the portion that is outside the City limits. Agreement: In consideration of the mutual covenants and agreements contained herein, as well as other good and valuable consideration the receipt and sufficiency of which is hereby acknowledged, the City and the County agree as follows: Section 1. Term. The term of this agreement will conm~ence on the Effective Date and will continue for a period of three years. Section 2. Roadway Construction. The City agrees to provide for the construction of the Improvements, by contract with an independent construction contractor. The City agrees that the Imprevements will meet or exceed County road construction standards. Section 3. County Contribution to Funding. The County agrees to contribute $300,000 towards the cost of constructing the Improvements. The County will make the first half of this contribution in a payment of $150,000 no later than January 31, 2003, and the County will make the second half of this contribution in a payment of $150,000 no later than January 31, 2004. These payments will be made at the office of the City Finance Department, 630 East Hopkins Street, San Marcos, TX 78666. Section 4. City Maintenance of Completed Roadway. The City agrees to maintain the Improvements, including the portion not presently located in the City limits.
