(b) any sums already collected which exceed permitted limits will be refunded to <br />Borrower. <br />5. NOTICES <br />Unless applicable law requires a different method, any notice that must or may be given to Borrower <br />under this Note will be given by hand delivery or by mailing same by first class mail, postage <br />prepaid, return receipt requested, to Borrower at Borrower's address above or at a different address if <br />Borrower gives the Lender a notice of Borrower's different address. <br />6. OBLIGATIONS OF BORROWERS UNDER THIS NOTE <br />If more than one person signs this Note, each person is fully personally obligated to keep all of the <br />promises made in this Note, including the promise to pay the full amount owed in the event of <br />Default. The Lender may enforce its rights under this Note against each person individually or <br />against all collectively. This means that any one of the above - mentioned persons may be required to <br />pay all of the amounts owed under this Note. <br />7. WAIVERS <br />Borrower waives notice of intention to accelerate, except as specifically provided herein, and the <br />rights of presentment and notice of dishonor. "Presentment" means the right to require the Lender to <br />demand payment of amounts due. "Notice of dishonor" means the right to require the Lender to give <br />notice to other persons that amounts due have not been paid. <br />8. PREPAYMENT OF NOTE <br />Borrower may prepay the original Deferred Principal Amount of this Note and any accrued interest at <br />any time prior to maturity without further penalty, e.g., in the event Borrower terminates the 380 <br />Agreement before the expiration of the term therein. <br />9. WORDS <br />In addition to the definitions provided previously herein, the terms "Borrower" and "Lender" and <br />other nouns and pronouns include the plural if more than one.
