NON - CONSENT AGENDA • 17. Consider an ordinance amending Section 2.067 of the San Marcos Citv Code to Dermit a person to be appointed to the Construction Board of Appeals and to another Dermanent citv board or commission: reducing the membership of the San Marcos Housing Authoritv Board of Directors from seven directors to five directors with one director to be a Dublic housing resident effective on January 1.2012: including Drocedural Drovisions: declaring an effective date: and consider ordinance on the first of two readings. MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember Thomason, the City Council voted seven (7) for and none (0) opposed, approve ordinance on first of two readings. The motion carried. 18. Consider an ordinance approving the abandonment of the allevwav off of Wilson Street between 1133 West San Antonio Street and 117 Wilson Street: aDDroving the convevance of this allevwav to the owner or owners of DroDerty abutting the allevway. authorizing the Citv Manag to execute one or more quitclaim deeds to such abutting owners: declaring an effective date: and consider ordinance on the first of two readings. MOTION: Upon a motion made by Councilmember Thomason and a second by Councilmember Prather, the City Council voted seven (7) for and none (0) opposed, to approve the ordinance on first of two readings. The motion carried. 19. Consider an ordinance amending the Land DeveloDment Code by adding a Land Use a Definition for Charitable Gaming Facilities to Chapter 8 and by allowing the land use as a conditional use in General Commercial and Heavv Commercial Zoning Districts under the Land Use Matrix Drovided in Chapter 4: Droviding a savings clause: Droviding for the repeal of anv conflicting Drovisions: Droviding an effective date: and consider ordinance on the first of two, readings. MOTION: Upon a motion made by Councilmember Thomason and a second by Councilmember Terry. Councilmember Thomason and Councilmember Terry withdrew their motions. MOTION: Upon a motion to table made by Councilmember Scott and a second by Councilmember Terry, the City Council voted five (5) for, one (1) opposed (Councilmember Porterfield), and one (1) abstained (Councilmember Prather-affidavit for business was filed with the City Clerk's Office -see attached copy). The motion carried. 20. Consider approval of moving Tuesday. December 21. 2010 Citv Council Regular Meeting date (Drovosed date is Tuesday. December 14. 2010). MOTION: Upon a motion made by Councilmember Thomason and a second by Councilmember Scott, the City Council voted six (6) for and one (1) opposed (Councilmember Terry), to move the December 21, 2010 City Council Regular Meeting to Tuesday, December 14, 2010.
