CHANGE ORDER No. 2 <br />CITY OF SAN MARCOS, TEXAS <br />PROJECT: Cottonwood Creek Elevated Storage Tank <br />CONTRACTOR: Landmark Structures, I, LP <br />ORIGINAL CONTRACT DATE: February 2, 2009 <br />CHANGE ORDER DATE: October 28, 2010 <br />WORK TO BE ADDED TO OR DELETED FROM SCOPE OF SERVICES <br />This Change Order constitutes full and mutual accord and satisfaction for all time and costs related to this particular change. <br />1. Apply two (2) City of San Marcos logos to the exterior of the Cottonwood Creek Elevated Storage Tank <br />per Proposed Contract Modification #6. The logos shall be of the size shown in the tank rendering <br />(included as an attachment). The logos shall be placed on each side of the tank viewable from the north <br />and south approach on State Highway 123. The color scheme shall comply with the City of San Marcos' <br />guidelines (included as an attachment) and shall include shading of the letter `M'. The Contractor agrees to <br />warranty the logo against defect for a period of 3 years. This warranty shall be provided to the City of San <br />Marcos directly from Landmark Structures' paint subcontractor, Lake Area Sign Company, L.L.C., in <br />writing as part of the supporting documentation for this Change Order. <br />2. The total contract amount will be revised to include the cost to apply two (2) logos in accordance with the <br />provisions outlined above in the amount of $27,900. <br />3. The date of Final Completion shall be extended from October 21, 2010 as established in the Certificate of <br />Substantial Completion to November 30, 2010. The Contractor shall begin work on November 1, 2010 and <br />complete all work related to this Change Order and all remaining punch list items that accompanied the <br />Certificate of Substantial Completion by November 30, 2010. Contract days shall be added to complete <br />punch list items #4, #45 and #46 if installation of the logo is delayed due to weather.
