• ORDINANCE 2010 -68 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 2.067 OF THE SAN MARCOS CITY CODE TO PERMIT A PERSON TO BE APPOINTED TO THE CONSTRUCTION BOARD OF APPEALS AND TO ANOTHER PERMANENT CITY BOARD OR COMMISSION; REDUCING THE MEMBERSHIP OF THE SAN MARCOS HOUSING AUTHORITY BOARD OF DIRECTORS FROM SEVEN DIRECTORS TO FIVE DIRECTORS WITH ONE DIRECTOR TO BE A PUBLIC HOUSING RESIDENT EFFECTIVE ON JANUARY 1, 2012; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Section 2.067 of the San Marcos City Code is hereby amended to read as follows (deleted language is shown with strikethroughs, added language is underlined) • Sec. 2.067. Membership on more than one board or commission. (a) A person may not be appointed as a member of more than one permanent city board or commission, except where duplicate appointments are authorized by ordinance, by the charter or by state law. (b) A person may serve on the San Marcos Industrial Development Corporation Board and on another permanent city board or commission. A person may serve on the Construction Board of Anneals and another city board or commission. SECTION 2. Effective on January 1. 2012. the membership of the San Marcos Housine Authority Board of Directors shall be reduced from seven (7) members to five (5) members with one of the five directors to be a public housina resident. Members shall serve two -year staeeered terms. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed. •
