• ORDINANCE 2010 -68 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 2.067 OF THE <br />SAN MARCOS CITY CODE TO PERMIT A PERSON TO BE <br />APPOINTED TO THE CONSTRUCTION BOARD OF <br />APPEALS AND TO ANOTHER PERMANENT CITY BOARD <br />OR COMMISSION; REDUCING THE MEMBERSHIP OF THE <br />SAN MARCOS HOUSING AUTHORITY BOARD OF <br />DIRECTORS FROM SEVEN DIRECTORS TO FIVE <br />DIRECTORS WITH ONE DIRECTOR TO BE A PUBLIC <br />HOUSING RESIDENT EFFECTIVE ON JANUARY 1, 2012; <br />INCLUDING PROCEDURAL PROVISIONS; AND <br />DECLARING AN EFFECTIVE DATE <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Section 2.067 of the San Marcos City Code is hereby amended to read as <br />follows (deleted language is shown with strikethroughs, added language is underlined) <br />• Sec. 2.067. Membership on more than one board or commission. <br />(a) A person may not be appointed as a member of more than one permanent city board <br />or commission, except where duplicate appointments are authorized by ordinance, by <br />the charter or by state law. <br />(b) A person may serve on the San Marcos Industrial Development Corporation Board <br />and on another permanent city board or commission. A person may serve on the <br />Construction Board of Anneals and another city board or commission. <br />SECTION 2. Effective on January 1. 2012. the membership of the San Marcos Housine <br />Authority Board of Directors shall be reduced from seven (7) members to five (5) members with <br />one of the five directors to be a public housina resident. Members shall serve two -year staeeered <br />terms. <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />• <br />
