partners, shareholders, agents, representatives and assigns, releases <br />TWC, and each of its predecessors, successors, divisions, committees, <br />parents, subsidiaries and affiliates, and each of their respective <br />employees, officers, directors, trustees, board members, members, <br />partners, shareholders, agents, representatives and assigns, from any and <br />all claims, liabilities, demands, actions, causes of action, suits, debts, <br />sums of money, damages, costs, expenses, attorneys' fees and remedies <br />of any type whatsoever, known or unknown, accrued or unaccrued, now <br />existing or hereinafter discovered regarding the Dispute, other than as <br />provided for in this Agreement. Without limiting the foregoing, TWC <br />understands and agrees that this release does not include any franchise <br />fee claims. <br />35. Neither this Agreement nor any negotiations or proceedings <br />connected with this Agreement shall be considered, offered, received as <br />or deemed to be evidence of an admission on the part of any Party hereto <br />of any fact, allegation, claim, statement, culpability, liability or wrongdoing <br />whatsoever, whether as alleged in connection with the Parties' dispute or <br />otherwise. <br />36. The Parties cannot alter or modify this Agreement except by an <br />instrument in writing executed by the Parties' duly authorized <br />representatives. <br />18 <br />
