ORDINANCE NO. 2010 -71 • AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS CHANGING THE RATE FOR ONCE PER WEEK COLLECTION OF RESIDENTIAL SOLID WASTE AND SINGLE STREAM RECYCLING SERVICE FROM $15.75 TO $15.51 PER MONTH, IMPLEMENTING SINGLE STREAM MULTI - FAMILY RECYCLING SERVICE AND ADOPTING A MONTHLY RATE OF $4.40 FOR SUCH SERVICE; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING AN EFFECTIVE DATE RECITALS: 1. The City Council approved an Amended and Restated Contract for Collection and Disposal of Solid Waste and Recyclable Materials on November 3, 2008 to provide single stream residential recycling. 2. The current rate for once a week collection of residential waste and recyclable materials is $15.75 implemented by Ordinance No. 2008 -52 adopted on third reading on November 7, 2008. 3. On December 7, 2010 the City Council considered a Second Amended and Restated Contract for Collection and Disposal of Solid Waste and Recyclable Materials that provides for single stream multi - family recycling and other solid waste services and adjusts the contract price. • BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. (a) Under Section 66.028 of the San Marcos City Code, the monthly charge for once per week collection and disposal of garbage, rubbish and single stream recycling service located in the city using bags and containers shall be: $15.51 per month from each residential unit $ 4.40 per month from each multi- family unit (b) Under Section 66.028 of the San Marcos Code the charge per 30 gallon bag placed for pickup outside the cart is as follows: $5.00 per bag for which a tag has been pre - purchased and is affixed onto the bag $8.00 per bag for which no tag has been affixed onto the bag (c) An $8.00 charge will be assessed when a cart is overloaded such that the cart overflow interferes with the mechanical loading of the cart into the solid waste truck. • 1
