65. INTERLOCAL AGREEMENT WITH SOUTHWEST TEXAS STATE UNIVERSITY FOR ARCHEOLOGICAL SURVEYS STATE OF TEXAS COUNTY OF HAYS The City of San Marcos ("San Marcos") and Southwest Texas State University ("SWT"), enter into this Interlocal Agreement under the authority of the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code, as amended. 1. SWT agrees to perform archeological surveys and site assessments for the City of San Marcos on a per project basis upon notification by the City in accordance with its Scope of Work attached to this Agreement as Attachment A. 2. The City agrees to pay SWT a not to exceed amount of $10,000.00 per project which will be based on hourly rates as described in Attachment B within 30 days of its receipt of an invoice from SWT. The City intends to engage SWT to perform archeological surveys in conjunction with approximately 15 City projects. The total of all fees charged by SWT will not exceed $75,000.00. 3. The City and SWT acknowledge that their payments for the services performed under this agreement will be made from current revenues available to each of them, and that the City's payment under this agreement is in an amount that fairly compensates SWT for these serVIces. 4. Either party may terminate this Agreement by giving 30 days advance written notice to the other party. 5. Neither party may assign this Agreement without the written consent of the other party. 6. This agreement will take effect immediately upon execution by both parties hereof and shall inure to the benefit and be binding upon the administrators, successors and assigns of the parties hereto. The term of this agreement will run from February 1, 2002 until January 31, 2003. This Agreement may be renewed upon 15 days written notice of intention to renew by the City.
