• PUBLIC HEARINGS HELD AT 6:00 P.M. 12. 6:OOPM Public Hearing to receive comment for or against the 2009 CDBG Consolidated Annual Performance Evaluation Report. At approximately 6:00 p.m. Mayor Guerrero opened the Public Hearing. There being no further comments, the Public Hearing was closed at 6:00 p.m. No Council action was required on this item. NON - CONSENT AGENDA 13. Consider adoption on emergency of Ordinance 2010 -75 amending Chapter 14, Article 1 of the San Marcos City Code by adding a new Section that establishes Maximum Building Heights in the Downtown Area; including procedural provisions; and providing an effective date. MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember Scott, the City Council voted (4) for and (3) opposed, (Councilmembers Prather, Thomason, and Terry) to adopt Ordinance 2010 -75, as previously captioned. The motion failed. MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember Porterfield, the City Council voted (7) for and (0) opposed, to approve the Ordinance on the first • of two readings on nonemergency. The motion carried unanimously. 14. Reconsideration of Ordinance 2010 -69 adopted on December 7, 2010 Regular Meeting, approving an amendment to the Future Land Use Map from "C" Commercial to "MDR" Medium Density Residential for a 3.41 acre, more or less, parcel of land out of lot 35 of the park at Willow Creek Subdivision located at 330 Stagecoach Trail; amending the Official Zoning May of the City by rezoning a 3.22 acre, more or less, portion of said parcel from "OP" Office Professional District to "SF -4.5" Single - Family District and the remaining 0.19 acre, more or less, portion of said parcel from "OP" Office Professional District to "TH" Townhouse Residential District; and including procedural provisions. No action taken. 15. Reconsideration of Ordinance 2010 -70 adopted on December 7, 2010 Regular Meeting, amending the Official Zoning Map of the City by rezoning a 2.65 acre, more or less, parcel of land out of Lot 34 of the Park at Willow Creek Subdivision located at 350 Stagecoach Trail from "TH" Townhouse Residential District to "SF -4.5" Single - Family District; including procedural provisions.
