k- PROFESSIONAL ENGINEERING SERVICES AGREEMENT This Agreement is effective this 19th of October, 2010 between the City of San Marcos, Texas, (the "City "), 630 East Hopkins, San Marcos, Texas 78666 and HDR Engineering, Inc. (the "Engineer "), 4401 West Gate Blvd., Austin, Texas 78745, for the provision of professional engineering services in connection with the Loop 82 /Aquarena Springs Drive Union Pacific Railroad Overpass Project (the "Project "). The City and the Engineer agree as follows: ARTICLE 1 ENGINEER'S SERVICES AND RESPONSIBILITIES 1.0 STANDARDS OF PERFORMANCE 1.0.1 The Engineer will be responsible for the proper, accurate and adequate design and preparation of reports, plans, specifications and other construction related documents for the Project. The Project generally includes the completion of a schematic design, the provision of environmental documentation and project Plans, Specifications and Estimates ( "PS &E ") which will provide for a grade separation of Loop 82 /Aquarena Springs Drive over the Union Pacific Railroad ( "UPRR ") tracks in front of the Texas State University Athletic Stadium from Thorpe Lane to Charles Austin Drive. In addition, the Project includes the design of a four -lane grade separation with two at -grade access roads between two diamond interchanges, with consideration to pedestrian, bicycle, and other traffic. Partial funding for the Project has been provided by the Texas Department of Transportation ( "TxDOT ") through a Local Transportation Project Advance Funding Agreement for Federal Earmark On- System Projects. The Engineer will perform all of its services for the City in compliance with the Local Transportation Project Advance Funding Agreement, CSJ #0016 -09- 033 as well as all federal, State and local regulations governing the use of grant funds for federal earmark on- system projects. The Engineer will develop the Project in coordination with TxDOT following all applicable TxDOT procedures and project development manuals. The Engineer will design the Project to meet 4R guidelines as defined in the TxDOT Roadway Design Manual and will submit all deliverables to the TxDOT for review and approval. Since this Project is a cooperative effort between the City and TxDOT, the Engineer will furnish all Project deliverables to the City for review and approval prior to submission to TxDOT for review and approval. 1.0.2 The Engineer's Basic Services consist of the services described in Sections 1.0 through 1.10 and include normal civil engineering services as well as those services the Engineer will perform through the following consulting disciplines as subconsultants to the Engineer: (1) Blanton & Associates, Inc. Environmental Studies (2) Survey & Mapping, Inc. Surveying HDR— Loop 82 Project Agreement
