k- <br />PROFESSIONAL ENGINEERING SERVICES AGREEMENT <br />This Agreement is effective this 19th of October, 2010 between the City of San Marcos, <br />Texas, (the "City "), 630 East Hopkins, San Marcos, Texas 78666 and HDR Engineering, Inc. <br />(the "Engineer "), 4401 West Gate Blvd., Austin, Texas 78745, for the provision of professional <br />engineering services in connection with the Loop 82 /Aquarena Springs Drive Union Pacific <br />Railroad Overpass Project (the "Project "). <br />The City and the Engineer agree as follows: <br />ARTICLE 1 <br />ENGINEER'S SERVICES AND RESPONSIBILITIES <br />1.0 STANDARDS OF PERFORMANCE <br />1.0.1 The Engineer will be responsible for the proper, accurate and adequate design and <br />preparation of reports, plans, specifications and other construction related documents for the <br />Project. The Project generally includes the completion of a schematic design, the provision of <br />environmental documentation and project Plans, Specifications and Estimates ( "PS &E ") which <br />will provide for a grade separation of Loop 82 /Aquarena Springs Drive over the Union Pacific <br />Railroad ( "UPRR ") tracks in front of the Texas State University Athletic Stadium from Thorpe <br />Lane to Charles Austin Drive. In addition, the Project includes the design of a four -lane grade <br />separation with two at -grade access roads between two diamond interchanges, with consideration <br />to pedestrian, bicycle, and other traffic. <br />Partial funding for the Project has been provided by the Texas Department of Transportation <br />( "TxDOT ") through a Local Transportation Project Advance Funding Agreement for Federal <br />Earmark On- System Projects. The Engineer will perform all of its services for the City in <br />compliance with the Local Transportation Project Advance Funding Agreement, CSJ #0016 -09- <br />033 as well as all federal, State and local regulations governing the use of grant funds for federal <br />earmark on- system projects. The Engineer will develop the Project in coordination with TxDOT <br />following all applicable TxDOT procedures and project development manuals. The Engineer <br />will design the Project to meet 4R guidelines as defined in the TxDOT Roadway Design Manual <br />and will submit all deliverables to the TxDOT for review and approval. Since this Project is a <br />cooperative effort between the City and TxDOT, the Engineer will furnish all Project <br />deliverables to the City for review and approval prior to submission to TxDOT for review and <br />approval. <br />1.0.2 The Engineer's Basic Services consist of the services described in Sections 1.0 through <br />1.10 and include normal civil engineering services as well as those services the Engineer will <br />perform through the following consulting disciplines as subconsultants to the Engineer: <br />(1) Blanton & Associates, Inc. Environmental Studies <br />(2) Survey & Mapping, Inc. Surveying <br />HDR— Loop 82 Project Agreement <br />
