11001855 OPR 4053 ?9 E <br />• <br />WO: 59270 <br />ACCT: 2176- 9363 -00 <br />FACET: 530309908 <br />NAME /DEV: Oakridge Booster Pump Station <br />The City of San Marcos <br />THE STATE OF TEXAS § <br />COUNTY OF HAYS <br />UTILITY EASEMENT <br />§ KNOW ALL MEN BY THESE PRESENTS: <br />That The City of San Marcos, of Hays County, Texas, for and in consideration of ONE <br />DOLLAR (S 1.00) paid by PEDERNALES ELECTRIC COOPERATIVE, INC. of Johnson City, <br />have granted, sold, and conveyed and by these presents do grant, sell, and convey unto <br />Pedernales Electric Cooperative, Inc. an easement and tight-of-way as hereinafter described for <br />the purpose an electric distribution line consisting of variable number of overhead wires, and all <br />necessary or desirable appurtenances (including poles made of wood, metal or other materials, <br />communications wire, props, guys) over, the following described lands located in Hays County, <br />Texas, to -wit: <br />Being all of Lot Nineteen (19) of Oak Ridge Estates, a subdivision in Hays <br />County, Texas being more particularly described in Volume 1, Page 71 of the <br />Official Plat Records, and Volume 1344, Page 515 of the Official Deed Records <br />all of Hays County, Texas. <br />• Easement hereby conveyed shall consist of: <br />o A strip of land 20 feet in width beginning at and centered with the terminus of an <br />existing overhead electric utility line on the Property and continuing in a <br />southwesterly direction ten feet on either side of the centerline of all electric <br />facilities extended from such existing line until reaching the edge of and <br />including a strip of land 20 feet in width running parallel with and bounded by <br />the northwest boundary line of the Property that begins 20 feet from the western <br />corner of the Property and continues for a distance of 170 feet as shown for <br />illustrative purposes only in Exhibit "A ". <br />Together with the right of ingress and egress over our adjacent lands to or from said right -of -way <br />for the purpose of constructing, reconstructing, inspecting, patrolling, hanging new wire on, <br />maintaining and removing said lines and appurtenances; the right to relocate within the limits of <br />said right -of -way; the right to remove from said easement all trees and parts thereof, or other <br />obstructions which endanger or may interfere with the efficiency of said lines or their <br />appurtenances. <br />TO HAVE AND TO HOLD the above described easement and rights unto Pedernales Electric <br />Cooperative, Inc. and their successors and assigns, until said line shall be abandoned. <br />And we do hereby bind ourselves, our heirs and legal representatives to warrant and forever <br />defend all and singular the above described easement and rights unto Pedernales Electric <br />Cooperative, Inc. their successors and assigns, against every person whomsoever lawfully <br />claiming or to claim the same or any part thereof. <br />0 <br />WITNESS my Tthis <br />— <br />Signature: <br />Printed Name: ( mes Nuse <br />Title: City vi a viager <br />City of San Marcos <br />day of QPASA 2010. <br />(NOTARIZE ON BACK) <br />
