2. The number of redemptions for all Program enhancement marketing efforts. <br />B. In addition to the above information, Simon shall provide the following information <br />to the City to demonstrate the effectiveness of the Program: <br />1. Simon will perform intercept surveys which capture data from guests who return <br />vouchers from the Program. The survey results will be provided to the City by February <br />28, 2011, May 31, 2011 and September 30, 2011. <br />2. Quarterly car traffic percentage increases will be calculated and provided to the City by <br />January 20, 2011, April 20, 2011, July 20, 2011 and October 20, 2011. <br />C. Any information furnished by Simon to the City relating to traffic, sales or costs <br />relating to San Marcos Premium Outlets is proprietary and confidential. The City agrees that <br />the information will be treated as confidential by the City to the extent permitted by law. In the <br />event a request for public disclosure is made for the information designated by Simon as <br />confidential, the City will notify that party, and will seek the opinion of the Texas Attorney <br />General as to the confidentiality of the information and the need to provide the information in <br />response to the disclosure request. <br />6.
