either the six months preceding the request or the period of time the account has been in • <br />the customer's name, whichever is shorter. <br />(f) A customer -side service call fee established by the city council must be paid <br />by a customer if the city dispatches a crew to a request for service from the customer, the <br />crew determines that the problem is on the customer's property, and the request for <br />service is related to the same problem at the same location within a 30 -day period. <br />(g) A repeat -line locate fee in the amount of the City's actual cost plus 10% must <br />be paid for second or subsequent water or wastewater utility line locates at the same <br />service location within 90 days of a previous line locate. <br />(h) Effective on January 1, 2009, an electric transformer cost recovery fee shall be <br />paid for new or upgraded residential, commercial, industrial, or institutional electric <br />service. The electric transformer cost recovery fee shall be set at the purchase price paid <br />by the San Marcos Electric Utility (SMEU) for each transformer. The fee will be waived <br />if a developer furnishes, at its own expense, transformers that meet SMEU's <br />specifications. The transformer cost recovery fee and the charge for setting a new power <br />pole shall be waived for any new home constructed by Habitat For Humanity. SMEU <br />will become the owner of the transformer at the time of installation. Transformer sizing <br />will be determined and /or approved by SMEU staff or a representative acting on SMEU's <br />behalf. <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this <br />• <br />ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, <br />the other provisions of this ordinance will continue in force if they can be given effect <br />without the invalid portion. <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 4.
