4. Invocation • <br />Spiritual Leader, Don Seiler from Unity Church San Marcos gave the invocation. <br />5. Pledge of Allegiance <br />Evan Mayhew, a 4th grader from the Gifted and Talented class at Maria Hernandez Elementary <br />School, led the assembly in the Pledge of Allegiance. <br />6. Citizen Comments <br />Earl Studdard, who resides at 2440 IH 35 S, San Marcos, TX 78666, introduced new Chamber of <br />Commerce President, Brian Bondy to the Council. Mr. Bondy greeted the Council and stated that he <br />was excited to be here in San Marcos and looked forward to working with the Council. <br />Jim Kimmel, who resides atl 10 Norcrest Drive, San Marcos, TX 78666, addressed the Council and <br />spoke in favor of the proposed EARIP measures. He also thanked the Council for seriously <br />considering protecting these areas. <br />7. Staff Report <br />Kristy Stark, Public Information Specialist, presented in place of Jennifer Shell, Interim Capital <br />Improvements Department Director. Kristy went over a PowerPoint that had been provided to <br />Council in their packets and answered any questions Council may have had regarding the projects • <br />presented. <br />CONSENT AGENDA <br />7. Consider approval of January 4, 201.1 Regular Meeting Minutes. <br />8. Consider adoption on second and final reading of Ordinance 2011 -03 amending the <br />City's 2010 -2011 Budget to authorize the expenditure of an amount not to exceed <br />$142,000 of Hotel Occupancy Tax Funds for the San Marcos Convention and Visitors' <br />Bureau to conduct a Marketing and Advertising Program to promote the San Marcos <br />Outlet Stores; and providing an effective date. <br />9. Consider adoption on second reading of Ordinance 2011 -04 amending section 86.198 of <br />the San Marcos City Code to exempt Habitat for Humanity from the requirement to pay <br />water and sewer service connection fees, electric power pole charges, and transformer <br />cost recovery fees for new homes constructed by that entity; including procedural <br />provisions; and declaring an effective date. <br />10. Consider adoption of Resolution 2011 -1OR finding it necessary to provide for public <br />involvement under Section 106 of the National Historic Preservation Act in connection <br />with the stabilization and rehabilitation of the Cephas House, a historically significant • <br />structure, located at 217 MLK Boulevard; authorizing City Staff to identify interested <br />
