<br />DESCRIBED IN THE DEED DATED SEPTEMBER 16, 2004, FROM JANE HOEFS, NOW KNOWN
<br />AS JANE JACKSON, TO SAN MARCOS CONSOLIDATED INDEPENDENT SCHOOL DISlRICT OF
<br />RECORD IN VOLUME 2544, PAGE 647, OFFICIAL PUBLIC RECORDS OF HAYS COUNTY,
<br />TEXAS; SAID 12.086 ACRES OF LAND, AS SURVEYED BY LOOMIS AUSTIN, INC., BEING
<br />MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS:

<br />COMMENCING at a Y2-inch iron rod found for the southwest comer of said 35.482 acre School District
<br />tract, being in the east right-of-way line ofFM Highway No. 2439 (Hunter Road), same being the east line
<br />of a 0.909 acre tract described in the deed from Jane Jackson to the State of Texas for right-of-way
<br />purposes ofrecord in Volume 1766, Page 429, Official Public Records of Hays County, Texas, being in the
<br />north line of a called 38.8548 acre tract described in a deed to M. Scott Krause and F. Jackson Krause of
<br />record in Volume 967, Page 123, Real Property Records of Rays County, Texas;

<br />THENCE with the east line of said 0.909 acre tract, same being the east right-of-way line of said FM
<br />Highway No. 2439, and being the west line of said 35.482 acre tract, being the arc of a curve to the left,
<br />having a radius of 1,502.39 feet, at an arc distance of 103.18 feet and a chord bearing N 42055' 38" E a
<br />distance of 103.16 feet pass a Yi-inch iron rod with plastic cap stamped "LAl" set at the intersection of the
<br />south line of a proposed 76-ft wide right-of-way to be known as Suttle Avenue, being dedicated by the
<br />proposed subdivision of said 35.482 acre tract known as the Jackson-Kone Subdivision with the said FM
<br />Highway No. 2439 right-of-way line, continuing with said curve to the left a total arc distance of 218.18
<br />feet, and a total chord bearing N 400 44' 04" E a distance of 217.99 feet to a Vl-inch iron rod with plastic
<br />cap stamped "LAl" set at the intersection ofthe north line of said proposed 76-ft wide right-of-way with the
<br />said FM Highway No. 2439 right-of-way line, for the southwest comer and POINT OF BEGINNING of
<br />the tract described herein;

<br />THENCE, continuing with the east right-of-way-line of said FM Highway No. 2439, being the east line of
<br />the said 0.909 acre State of Texas right-of-way tract and the west line of said 35.482 acre School District
<br />tract, the following two (2) courses and distances:

<br />1) with the arc of a curve to the left, having a radius of 1,502.39 feet, an arc distance of 401.21 feet and a
<br />chord bearing N 280 55' 26" E a distance of 400.02 feet to a Type II Texas Department of
<br />Transportation concrete monument found at a point of tangency, and
<br />
<br />2) N 21005' 31" E a distance of 240.58 feet to a cotton gin spindle found for the most western northwest
<br />comer of said 35.482 acre School District tract, being in the south line of that certain tract of land
<br />called to be 2.68 acres as described in a deed dated May 20, 1987, from Germer and Lowe to Woodrow
<br />F. High, Jr. of record in Volume 675, Page 293, Real Property Records, Hays County, Texas, said
<br />cotton gin spindle being the northeast comer of the said 0.909 acre State of Texas right-of-way tract for
<br />the western northwest comer of the tract described herein;

<br />THENCE S 440 11' 26" E, leaving the east right-of-way-line ofFM Highway No. 2439, with the western
<br />north line of the said 35.482 acre School District tract, being the south line of the said 2.68 acre High tract,
<br />a distance of 334.63 feet to a cedar fence post found at a re-entrant comer of the said 35.482 acre School
<br />District tract, being the southeast comer of the said 2.68 acre High tract, for a re-entrant comer of the tract
