<br />:I <br />C'J <br />W~ <br />~ <br />~ <br /> <br />fI) <br />LC") 0 <br />C) ~ e <br />c::> a: <U <br /><'J w~ <br />"'d'I .....l c: <br />CQ () cu <br />>-00 <br />CD !::'O <br />lJ.J 0 >. <br />I.L.. ... <br />o <br /> <br />48. <br /> <br />ORDINANCE NO. 2005 M -IL <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING ARTICLE 4, <br />STOPPING, STANDING, PARKING, OF CHAPTER 82, <br />TRAFFIC AND VEHICLES, OF THE SAN MARCOS CITY <br />CODE TO AUTHORIZE CERTAIN PERSONS TO <br />ENFORCE DISABLED PARKING REGULATIONS; <br />ALLOWING THE CHIEF OF POLICE TO APPOINT SUCH <br />PERSONS; INCLUDING PROCEDURAL PROVISIONS; <br />AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. Chapter 681 of the Texas Transportation Code allows a city to appoint civilians <br />to have the authority to file charges against a person who commits an offense under the <br />state disabled parking statutes. <br /> <br />2. The experience of the city police and parking technicians in enforcing disabled <br />parking regulations has indicated the value of having added enforcement resources. <br /> <br />3. The City Council wishes to delegate to the chief of police the authority to <br />implement the procedures necessary to appoint qualified persons. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Section 82.171 of the San Marcos City Code is amended as follows <br />(underlinino indicates added text, strikethrough indicates deleted text): <br /> <br />Sec. 82.171. Disabled parking spaces. <br /> <br />~ The traffic engineer is authorized to determine the location for disabled <br />parking spaces for vehicles transportino persons with disabilities. and shall place <br />and maintain appropriate signs and markings indicating these parking spaces. <br />No person shall stand or park a vehicle in a handicapped parking space unless <br />authorized to do so under state law. <br /> <br />(b) In addition to police officers and appointed parkino technicians. other <br />persons meetino the qualifications under V.T.C.A.. Transportation Code. Section <br />681.0101. and other qualifications prescribed by the chief of police, may be <br />appointed and trained by the chief of police to enforce state disabled parkino <br />provisions on public and private property. <br />
