ORDINANCE NO. 2005 M -IL AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ARTICLE 4, STOPPING, STANDING, PARKING, OF CHAPTER 82, TRAFFIC AND VEHICLES, OF THE SAN MARCOS CITY CODE TO AUTHORIZE CERTAIN PERSONS TO ENFORCE DISABLED PARKING REGULATIONS; ALLOWING THE CHIEF OF POLICE TO APPOINT SUCH PERSONS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. Chapter 681 of the Texas Transportation Code allows a city to appoint civilians to have the authority to file charges against a person who commits an offense under the state disabled parking statutes. 2. The experience of the city police and parking technicians in enforcing disabled parking regulations has indicated the value of having added enforcement resources. 3. The City Council wishes to delegate to the chief of police the authority to implement the procedures necessary to appoint qualified persons. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Section 82.171 of the San Marcos City Code is amended as follows (underlinino indicates added text, strikethrough indicates deleted text): Sec. 82.171. Disabled parking spaces. ~ The traffic engineer is authorized to determine the location for disabled parking spaces for vehicles transportino persons with disabilities. and shall place and maintain appropriate signs and markings indicating these parking spaces. No person shall stand or park a vehicle in a handicapped parking space unless authorized to do so under state law. (b) In addition to police officers and appointed parkino technicians. other persons meetino the qualifications under V.T.C.A.. Transportation Code. Section 681.0101. and other qualifications prescribed by the chief of police, may be appointed and trained by the chief of police to enforce state disabled parkino provisions on public and private property.
