<br />assurances from their suborganizations, as required by 14 CPR Part 152, Subpart E, to the same <br />effect. <br /> <br />14.08. During the time of war or national emergency, the Lessor shall have the right to lease all or <br />part of the landing areas at the Airport to the Federal government for military use, and, if a lease is <br />executed, the provisions of this Lease shall be suspended to the extent they are inconsistent with the <br />provisions of the lease to the government. <br /> <br />14.09. The Lessor shall have the right to enter the Leased Premises at all reasonable hours for the <br />purpose of inspection. The Lessor shall not be liable to the Lessee for any expense, loss, or damage <br />from any such entry upon the Leased Premises. <br /> <br />14.10. The right to furnish aeronautical services to the public is granted to the Lessee subject to the <br />Lessee agreeing: <br /> <br />A to furnish the services on a fair, equal and nondiscriminatory basis to all users, and <br /> <br />B. to charge fair, reasonable and nondiscriminatory prices for each unit or service. The <br />Lessee may offer reasonable and nondiscriminatory discounts, rebates, or similar price reductions to <br />volume purchasers. <br /> <br />Article 15. MisceDaneous <br /> <br />15.01. When the singular number is used in this Lease, it will include the plural when appropriate, <br />and the neuter gender will include the feminine and masculine genders when appropriate. <br /> <br />15.02. Ifany clause or provision oftbis Lease is illegaL invalid or unenforceable under present or <br />future laws, this Lease will remain in effect, and the remaining provisions will continue in force if they <br />can be given effect without the invalid portion. <br /> <br />15.03. This ~e may be amended only by an instrument in writing signed by both parties, or by City <br />Council review of the rental fees every five years as allowed by the :Minimum Standards. This Lease <br />shall apply to and be binding upon the parties, and upon their respective successors in interest and <br />legal representatives, unless otherwise expressly provided in this Lease. <br /> <br />15.04. The captions used in this Lease are for convenience only and do not in any way limit or <br />amplify the terms and provisions of this Lease. <br /> <br />15.05. One or more waivers of any covenant, term or condition of this Lease by either party sbaU not <br />be deemed as a waiver by that party as to any subsequent similar act or omission. <br /> <br />15.06. Whenever a period of time is prescribed for action to be taken by the Lessor, any delays due <br />to strikes, riots, acts of God, shortages of labor or materials, war, govemmentallaws, regulations or <br /> <br />COSM form 1/99 <br />
