SECTION 4. Consistent with the requirements of the Regulations, the development and <br />operation of any golf course within the Project Site shall be in accordance with the standards and • <br />requirements of the Audubon International Signature Program for Golf Courses (the "Program "), <br />as set for the in the attached Exhibit "C ". If the entity responsible for the creation, publication <br />and administration of the Program dissolves or ceases to exist, the standards and requirements of <br />the Program as contained in Exhibit "C" shall continue to govern the development and operation <br />of any golf course within the Project Site. When established under the Program, the schedules <br />for the application of pesticides and herbicides and for testing of ground water adjacent to any <br />golf course shall be presented to the San Marcos City Council. All such test results under the <br />Program shall be posted on an internet website freely available to the public for viewing and <br />inspection. <br />SECTION 5. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City <br />Code upon conviction. <br />SECTION 6.
