<br />124. <br /> <br />RESOLUTION NO. 2005- ----51L R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING THE TERMS <br />AND CONDITIONS OF AN INTERLOCAL AGREEMENT <br />BETWEEN THE CITY AND THE SAN MARCOS <br />CONSOLIDATED INDEPENDENT SCHOOL DISTRICT <br />REGARDING THE NEW HIGH SCHOOL PROJECT; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The San Marcos Consolidated Independent School District (the "School District") is <br />planning to develop a new San Marcos High School facility (the "High School Project") on a <br />98.66 acre, more or less, site (the "Project Site") located near the intersection of McCarty Lane <br />and Old Bastrop Road, within the City limits of the City. <br /> <br />2. The City has enacted a Land Development Code (the "LDC") that includes <br />regulations for developments such as the High School Project, such as parking and landscaping <br />requirements. <br /> <br />3. In an effort to fully comply with, and in some cases, exceed, the parking and <br />landscaping requirements of the LDC, the School District is proposing to take a phased <br />approach toward meeting these requirements as they relate to the High School Project. <br /> <br />4. The City Council is willing to agree to the School District's phased approach as <br />described in the attached interlocal agreement. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />P ART 1. The attached interlocal agreement between the City and the School District <br />regarding the High School Project is approved. <br /> <br />PART 2. The City Manager, Dan O'Leary, is authorized to execute the agreement on <br />behalf of the City. <br /> <br />PART 3. This Resolution is in full force and effect immediately from and after its <br />adoption. <br /> <br />ADOPTED on May 3, 2005. <br />
