• ORDINANCE NO. 2011- 0 6 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING CHAPTER 86, ARTICLE 9, <br />CROSS CONNECTION CONTROL AND BACKFLOW <br />PREVENTION, OF THE SAN MARCOS CITY CODE; <br />ESTABLISHING PENALTIES FOR THE VIOLATION THEREOF; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />AN EFFECTIVE DATE <br />RECITALS: <br />1. The City of San Marcos has adopted a cross connection control and <br />backflow prevention ordinance as mandated by applicable state law. <br />2. City staff recommends revisions to the ordinance, to include among other <br />things, the addition of a schedule of fines and civil penalties for violations of the <br />ordinance. <br />3. The adoption of this ordinance is in the interest of the public health safety <br />and welfare. <br />• BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br />SECTION 1. Chapter 86, Utilities, Article 9, Cross Connection Control and <br />Backflow Prevention, of the San Marcos City Code is hereby amended to read as follows: <br />ARTICLE 9. CROSS CONNECTION <br />CONTROL AND BACKFLOW PREVENTION <br />DIVISION 1. GENERALLY <br />Sec. 86.551. Purpose. <br />The purposes of this article are to: <br />(1) Protect the city potable water system from contamination or pollution by <br />preventing contaminants and pollutants within the water systems of <br />customers from entering the city water system. <br />(2) Provide for the maintenance of a continuing program of cross connection <br />control by requiring the installation of approved backflow prevention <br />assemblies as required by the plumbing code adopted under chapter 14 of <br />• this Code, and requiring the certification and operational testing of all <br />testable backflow prevention assemblies. <br />1 <br />
