RECITALS: 1. The Building Inspections Division of Planning and Development Services Department has revlewed the fee structure and determined that certain fees do not reflect the actual costs associated with providing inspection services, particularly for remodeling permits, and has recommended lowering these fees to reflect the actual costs to the City. 2. In reviewing the fee structure the Building Inspections Division determined that permit fees for remodeling work should be tiered according to the complexity of the work. 3. The City Council wishes to implement the fee restructuring and decreases recommended by the Building Inspections Division. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The schedule of fees for Building Inspections Division services attached to this ordinance as Exhibit A is approved. SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 4. This Ordinance will take effect 10 days after the date of its final passage, and the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City.
