The City Code of Ordinances makes it unlawful to conduct any outdoor commercial car <br />washing activity on a year round basis including mobile systems. It exempts on premises car <br />washing activities at bona fide car washing businesses. <br /> <br />2. The technology is currently available for mobile pressure wash systems to provide for low <br />water consumption and with more water efficiency than hose washing vehicles or structures. <br />Mobile systems can be as efficient as bona fide car washing businesses. <br /> <br />3 . Water and wastewater staff agree that the prohibition against mobile systems does not <br />accomplish the conservation goal contemplated in the section and recommends the council <br />approve the attached revisions to the ordinance which allow the use of mobile pressure <br />washing systems in the city. <br /> <br />4. Wash activities will continue to be limited or interrupted when Stages 2,3 or 4 water use <br />restrictions are placed in effect per the City water conservation plan as approved by the EAA. <br />The mobile systems will be restricted in these cases to the same degree as fixed base <br />operations. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Section 86.056 of the San Marcos City Code is amended by adding <br />definitions as follows: <br /> <br />Sec. 86.056. Definitions. <br /> <br />Bona fide car washing business means a commercial business equipped with <br />mechanical or automatic car washing equipment inside a structure that is covered <br />and enclosed on at least two sides. <br /> <br />Charitable car washing activity means any activity involving the washing of <br />vehicles for a donation on premises other than a bona fide car washing business. <br /> <br />Mobile car wash means a commercial business equipped with a vehicle or <br />trailer mounted self contained washing system with water or detergent solution <br />
