ORDINANCE NO. 2011 - 11 <br />• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING SECTION 2.566 OF THE SAN <br />MARCOS CITY CODE TO AUTHORIZE THE CITY MANAGER TO <br />APPROVE INDIVIDUAL CHANGE ORDERS IN AMOUNTS NOT <br />TO EXCEED $100,000 EACH IN CIRCUMSTANCES INVOLVING A <br />PUBLIC CALAMITY, UNFORSEEN DAMAGE TO PUBLIC <br />MACHINERY, EQUIPMENT OR PROPERTY OR WHEN <br />OTHERWISE NECESSARY TO PRESERVE OR PROTECT THE <br />HEALTH OR SAFETY OF CITY RESIDENTS; REQUIRING THE <br />CITY MANAGER TO MAKE QUARTERLY REPORTS TO THE <br />CITY COUNCIL OF EACH CHANGE ORDER IN EXCESS OF <br />$25,000 APPROVED UNDER THE AUTHORITY OF THIS <br />ORDINANCE; INCLUDING PROCEDURAL PROVISIONS; AND <br />DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. Chapter 252 of the Texas Local Government Code governs the purchasing and <br />contracting authority of municipalities. <br />2. Section 252.048 of the Texas Local Government Code currently requires <br />• governmental body approval of each additive or deductive change orders in <br />excess of $25,000. <br />3. Section 252.022 of the Texas Local Government Code further provides that <br />certain types of procurements are exempt from the limitations and <br />requirements of Chapter 252, including those necessary to deal with public <br />calamities, unforseen damage to public machinery, equipment or other <br />property, or to preserve or protect the public health or safety of the <br />municipality's residents. <br />4. The City Council deems it necessary to authorize the city manager to approve <br />change orders without approval of the Council in amounts not exceeding <br />$100,000 in narrowly defined circumstances where an emergency <br />procurement would be exempt from all requirements of Chapter 252 of the <br />Texas Local Government Code. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Chapter 2, Section 2.566 of the San Marcos City Code is amended as <br />• follows (underlining indicates added text, str indicates deleted text): <br />
