INTERLOCAL AGREEEMENT This contract and agreement is entered into by and between the agencies shown below as contracting parties, pursuant to the authority granted and in accordance with Texas Government Code, Chapter 791 "Interlocal Cooperation Contracts" to provide special or technical services, including services of employees, materials, and equipment. I. CONTRACTING PARTIES: The Receiving Agency: City of San Marcos (CITY) The Performing Agency: Texas State University- San Marcos (TXSTATE) II. STATEMENT OF SERVICES TO BE PERFORMED: A) TXSTATE designates Dr. Thom Hardy as its contact for project performance matters related to this Agreement. TXSTATE designates Mr. Scott Erwin, Sr. as TXSTATE's representative for all other matters related to the Agreement. B) TXSTATE will conduct a ground - penetrating radar survey of the San Marcos River, undertaking the scope of work outlined in Attachment A. TXSTATE shall submit a progress report on this study no later than three months from the effective date of this Agreement as established in Section V below. TXSTATE shall submit a final report no later than six months from the effective date of this Agreement. All data and analyses resulting from this study shall be freely accessible and publishable by both TXSTATE and the CITY. III. CONTRACT AMOUNT: The total amount of the contract shall not exceed: $25,000.00. IV. PAYMENT FOR SERVICES: TXSTATE shall bill for services it provides on a monthly basis. Invoices shall include identification of the expenses incurred and details of work completed during the invoice period. V. TERM OF CONTRACT: The effective date of this Agreement is April 1, 2011 or upon signature by both parties, whichever is later and shall terminate upon TXSTATE's satisfactory completion of services and the City's acceptance of the final report which shall occur no later than September 1, 2011. Without waiving any applicable remedies available to a party, before pursuing such remedies, the parties will use the procedures in Government Code Chapter 2260, Subchapter B to resolve any disputes regarding this contract.
