• RESOLUTION NO. 2011R - 42 <br />A RESOLUTION OF THE CITY OF SAN MARCOS, TEXAS, ENDORSING THE <br />IMPLEMENTATION OF A CONTINUING PRETREATMENT PROGRAM AS <br />REQUIRED BY 40 CFR 403 FOR THE CITY OF SAN MARCOS WASTEWATER <br />SYSTEM. <br />WHEREAS, on June 26, 1978, the United States Environmental Protection Agency published a <br />rule (amended January 28, 198 1) which established mechanisms and procedures for enforcing National <br />Pretreatment Standards controlling the introduction of wastes from non - domestic sources into Publicly <br />Owned Treatment Works (POTWs); and <br />WHEREAS, this rule, 40 CFR 403, requires that a Pretreatment Program be developed for the <br />City of San Marcos Wastewater System; and <br />WHEREAS, The City has adopted a pre- treatment ordinance that complies with rule 40 CFR 403; <br />and <br />WHEREAS, 40 CFR 403.9(b)(2) requires a statement or resolution reflecting the endorsement or <br />approval of the local boards or councils responsible for supervising and/or funding the POTW; <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />PART 1. That the City of San Marcos Texas, hereby endorses the implementation of a pretreatment <br />• program as required by 40 CFR 403 for the San Marcos Wastewater System with such program to <br />continue as long as 40 CFR 403 remains in effect. <br />PART 2.
