<br />B. County Agreements: <br /> <br />The County Agrees to: <br /> <br />1. Designate Richard Salmon, County Grants Administrator, as the County's <br />representative in all matters related to this agreement. <br />2. Cooperate with the City's Parks and Recreation Department as necessary. <br />3. Utilize focus groups available to the County in order to provide input in designing <br />the Project. <br />4. Utilize $150,000.00 in grant funding from the Lower Colorado River Authority's <br />Parks in Partnership Program ("PIP") Grant Program for the development of the <br />Project. <br />5. Utilize $500,000.00 in grant funding from the Texas Park and Wildlife Department's <br />outdoor Grant Program for the development of the Project. <br />6. Present a final park plan of the Project to the Hays County Commissioner's Court for <br />approval prior to construction to the Project. <br />7. Secure the use of energy efficient building materials and innovative power systems in <br />the design of the Project to the extent the County has any control of the design. <br />8. Grant full permission to the City to operate and maintain the Project after the Project <br />has been satisfactorily completed. <br /> <br />Section 2. Insurance <br /> <br />Both parties to this Agreement understand that the County will maintain casualty insurance <br />coverage or otherwise guarantee that any improvements made in connection with the <br />Project that are damaged by a fire, storm, flood or other casualty event will be replaced or <br />restored with like kind and quality to its pre-occurrence condition. <br /> <br />Section 3. Term <br /> <br />The term of this Agreement will commence on July 5 ,2005 and will end on <br />July 5 ,2010. This agreement will renew automatically for successive five year term <br />unless terminated by either party in accordance with section 3.G. <br /> <br />Section 4. Miscellaneous Provisions <br /> <br />A. Interlocal Cooperation: The City and the County agree to cooperate with each other in <br />good faith at all times during the term of this Agreement in order to achieve the purposes and <br />intent of the Agreement. Each party to this Agreement acknowledges and represents that this <br />Agreement has been executed by its duly authorized representative. <br /> <br />B. Funding: The City and County acknowledge that funding under this Agreement will be made <br />from current revenues available to the City and the County. Funds for the participation in this <br />Agreement have been provided through the City budget approved by City Council for the current <br />fiscal year only. State statues prohibit the obligation and expenditure of public funds beyond the <br />fiscal year for which a budget has been approved.
