<br />2005-483-553 <br /> <br />16. <br /> <br />STATE OF TEXAS <br />COUNTY OF TRAVIS <br /> <br />TWDB Contract No. 2005-483- <br /> <br />Research and Planning Fund <br />Flood Protection Planning <br /> <br />THIS Contract, (hereinafter "CONTRACT"), between the Texas Water Development <br />Board (hereinafter "BOARD") and City of San Marcos (hereinafter "CONTRACTOR(S)"), is <br />composed of two parts, Section I. Specific conditions and exceptions to the standard agreement <br />and Section II. Standard Agreement. The terms and conditions set forth in Section I will take <br />precedence over terms and conditions in Section II. <br /> <br />SECTION I. SPECIFIC CONDITIONS AND EXCEPTIONS <br />TO STANDARD AGREEMENT <br /> <br />ARTICLE I. DEFINITIONS: For the purposes of this CONTRACT, the following terms or <br />phrases shall have the meaning ascribed therewith: <br /> <br />A. BOARD - The Texas Water Development Board, or its designated representative <br /> <br />B. CONTRACTOR(S) - City of San Marcos <br /> <br />C. EXECUTIVE ADMINISTRATOR - The Executive Administrator of the Board or <br />his designated representative <br /> <br />D . PARTICIPANT(S) - City of San Marcos <br />E. REQUIRED INTERLOCAL AGREEMENT(S) - N/A <br /> <br />F. BOARD APPROVAL DATE - March 15,2005 <br /> <br />G. PLANNING AREA - The watersheds of Willow Springs Creek, Purgatory Creek, <br />Bypass Creek, Sessom Creek tributary of the San Marcos River, Schulle Canyon <br />tributary to Sink Creek, and the Blanco River; all within the corporate jurisdiction <br />of the City ant its ET J and out into the unincorporated areas of Hays County. The <br />project area is more specifically defined in Exhibit A (the original grant <br />application). <br /> <br />H. DEADLINE FOR CONTRACT EXECUTION - June 23.2005 <br /> <br /> <br />I. CONTRACT INITIATION DATE - March 15,2005 <br /> <br />J. STUDY COMPLETION DATE- December 31, 2007 <br /> <br />K. FINAL REPORT DEADLINE - February 29, 2008 <br /> <br />L. [ TOTAL STUDY COSTS - $ 433,500 <br /> <br />M. BOARD SHARE OF THE TOTAL STUDY COSTS - Not to exceed $200,000 or <br />46.139 percent of the total study costs or individual voucher submission <br /> <br />N.
