<br />(3) Construction noise from construction activities that are required in order for the installation <br />or performance of certain systems or subsystems to meet best practices of building construction. This <br />exception will apply only upon the Building Official's prior written approval. To obtain the Building <br />Official's approval a contractor must provide written certification from a Licensed Professional <br />Engineer and any other infornlation the Building Official determines is required to prove that the <br />activity is required for best practices. Granting the exception is within the sole discretion of the <br />Building Official. <br /> <br />(d) A person who violates this section commits a misdemeanor and is subject to a fine of not less <br />than $250.00 upon conviction. <br /> <br />Sees. 14.012-14.025. Reserved. <br /> <br />ARTICLE 2. BUILDING CODE <br /> <br />Sec. 14.026. Amendments. <br /> <br />The International Building Code adopted by section 14.002 is amended as follows: <br /> <br />101.2 exception 2 is deleted <br /> <br />101.4.1 is deleted and replaced with the following: <br /> <br />101.4.1 Electrical. The provisions of the National Electrical Code 2002 will apply to the <br />installation of electrical systems, including alterations, repairs, replacement, equipment, <br />appliances, fixtures, fittings and appurtenances thereto. <br /> <br />101.5 is added. <br /> <br />101. 5 Nothing within this code shall be construed as limiting the application and enforcement <br />of this code in areas such as Extra-Territorial Jurisdiction (ETJ) as may be allowed by local, <br />state, or federal laws, ordinances, or codes. <br /> <br />103 is deleted. <br /> <br />104. 7 is deleted. <br /> <br />105.1 is deleted and replaced with the following: <br /> <br />105.1 Required. Any owner or authorized agent who intends to construct, enlarge, alter, <br />repair, move, demolish, or change the occupancy classification of a building or structure, or to <br />erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical <br />or plumbing system, the installation of which is regulated by this code, or to cause any such <br />work to be done, shall first make application to the building official and obtain the required <br />permit. If the owner is to do the work him or herself, then the owner shall provide an affidavit <br />to the building official stating that he owns and presently occupies the building as his <br />homestead. <br /> <br />5 <br />
