2. PUBLIC UTILITIES <br />ITT is responsible for the provision of any and all required electrical power and /or <br />telecommunications services to the leased premises for the term of this Agreement. The <br />Lessor is not responsible to provide or pay for any type of public utilities at or on the <br />leased site. ITT shall install at its sole cost and expense a separate meter or submeter for <br />utilities used on the premises by ITT at a location determined by the Lessor. Service <br />through individual electrical meters that exclusively serve the Leased Premises shall be in <br />the name of Lessee. <br />3. TAXES <br />ITT shall be responsible for the payment of any applicable taxes, fees or governmental <br />assessments against any equipment, personal property and /or improvements owned, <br />leased or operated by ITT. Failure to pay applicable taxes, fees or governmental <br />assessments shall be an event of default under Section 17 herein. <br />4. INSURANCE <br />ITT will procure and maintain in full force during the term of this lease at ITT's expense <br />insurance with insurance companies authorized to do business in the State of Texas, <br />covering all operations under this Agreement, whether performed by ITT or ITT's agents, <br />subcontractors or employees. Before commencing the work and for the duration of this <br />Agreement, ITT will furnish to the City a certificate or certificates in form satisfactory to <br />the City, showing that ITT has complied with this paragraph. All certificates will provide <br />that the policy will not be changed or canceled until at least thirty (30) calendar days <br />written notice has been given to the City. Commercial general liability and motor vehicle <br />insurance will be written with the City of San Marcos, Texas as an additional insured and <br />will be endorsed to provide a waiver of the carrier's right of subrogation against the City. <br />The kinds and amounts of insurance required are as follows: <br />1. Worker's Compensation Insurance with statutory limits in accordance with all <br />applicable state, federal and maritime laws, and Employers' Liability Insurance with <br />minimum limits of $500,000 per accident/occurrence, or in accordance with all <br />applicable state, federal and maritime laws. <br />2. Commercial General Liability Insurance (Bodily Injury and Property Damage) the <br />limits of liability of which shall not be less than $1,000,000 per occurrence. <br />3. A certificate of insurance at required coverage limits shall be provided to the Lessor <br />within one week of the execution of this Agreement and upon expiration of each term <br />thereafter. <br />3 <br />
