• ORDINANCE N0.2011 - 13 <br />AN ORDINANCE AMENDING CHAPTER 86, ARTICLE 3, DIVISION 2, <br />INDUSTRIAL WASTE DISCHARGE REGULATIONS, OF THE SAN <br />MARCOS CITY CODE BY REPEALING ARTICLE 3, DIVISION 2 IN ITS <br />ENTIRETY AND REPLACING IT WITH A REVISED ARTICLE 3, <br />DIVISION 2; AUTHORIZING THE ISSUANCE OF INDIVIDUAL <br />WASTEWATER DISCHARGE PERMITS; PROVIDING FOR <br />MONITORING, COMPLIANCE, AND ENFORCEMENT ACTIVITIES; <br />ESTABLISHING ADMINISTRATIVE REVIEW PROCEDURES; <br />REQUIRING USER REPORTING; AND PROVIDING AN EFFECTIVE <br />DATE. <br />RECITALS: <br />1. The Environmental Protection Agency ( "EPA ") has adopted regulations that <br />streamline general pretreatment regulations for existing and new sources of <br />pollution which are codified as 40 C.F.R. Parts 9, 122 and 403 (referred to herein <br />as "streamlining regulations "). <br />2. The streamlining regulations address requirements for, and oversight of, industrial <br />users who introduce pollutants into Publicly Owned Treatment Works (POTW) <br />• and includes changes to certain program requirements to be consistent with <br />National Pollutant Discharge Elimination System (NPDES) requirements for <br />direct dischargers to surface waters and to reduce the regulatory burden on both <br />Industrial Users and State and POTW Control Authorities without adversely <br />affecting environmental protection and will allow Control Authorities (CA) to <br />better focus oversight resources on Industrial Users with the greatest potential for <br />affecting POTW operations or the environment. <br />3. As a result of these streamlining regulations the City is required to make <br />modifications to the Industrial Discharge Regulations set forth in Chapter 86, <br />Article 3, Division 2, of the San Marcos City Code to comply with the mandatory <br />provisions of the federal streamlining regulations. <br />4. Compliance with the streamlining regulations can be achieved by repealing the <br />existing Article 3, Division 2 of the Industrial Waste Discharge Regulations and <br />replacing it with a revised Article 3, Division 2, Industrial Waste Discharge <br />Regulations. This ordinance has been reviewed and approved by the TCEQ. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br />SECTION 1. Chapter 86, Article 3, Division 2, Industrial Waste Discharge <br />Regulations, of the San Marcos City Code is hereby amended by repealing the current <br />Article 3, Division 2 in its entirety and replacing it with a new Article 3, Division 2 as <br />• follows: (deletions are shown with ms s, additions are underlined): <br />1 <br />
