ORDINANCE 2005- S7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 26, CIVIL EMERGENCIES, OF THE CITY CODE TO ADOPT FEDERAL EMERGENCY SYSTEM INCIDENT MANAGEMENT STANDARDS; INCLUDING PROCEDURAL PROVISIONS. RECITALS: 1. Homeland Security Presidential Directive (HSPD)-5, Management of Domestic Incidents (the Directive), requires all federal Departments and agencies to adopt the National Incident Management System (NIMS) and to use it in domestic incident management. 2. NIMS incorporates the Incident Command System (ICS) as one of its components. 3. The Directive requires Federal departments and agencies to make adoption of the NIMS by state and local organizations a condition for federal preparedness assistance (including grants, contracts and other assistance). 4. The City Council wishes to adopt NIMS as the City's standard command and control system during emergency operations. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS. TEXAS: SECTION 1. Chapter 26, Civil Emergencies, of the San Marcos City Code is amended by adding Section 26.040 as follows: Sec. 26.040. National Incident Management System. The National Incident Management System - Incident Command System is the standard command and control system during emergency operations. SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed.
