Homeland Security Presidential Directive (HSPD)-5, Management of Domestic <br />Incidents (the Directive), requires all federal Departments and agencies to adopt the <br />National Incident Management System (NIMS) and to use it in domestic incident <br />management. <br /> <br />2. NIMS incorporates the Incident Command System (ICS) as one of its <br />components. <br /> <br />3. The Directive requires Federal departments and agencies to make adoption of the <br />NIMS by state and local organizations a condition for federal preparedness <br />assistance (including grants, contracts and other assistance). <br /> <br />4. The City Council wishes to adopt NIMS as the City's standard command and <br />control system during emergency operations. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS. <br />TEXAS: <br /> <br />SECTION 1. Chapter 26, Civil Emergencies, of the San Marcos City Code is <br />amended by adding Section 26.040 as follows: <br /> <br />Sec. 26.040. National Incident Management System. <br /> <br />The National Incident Management System - Incident Command System is <br />the standard command and control system during emergency operations. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in force if they can be given effect without <br />the invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />
