<br />139. <br /> <br />RESOLUTION 2005 - <br /> <br />gg <br /> <br />R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY SAN MARCOS, TEXAS TO IMPLEMENT <br />AND ENFORCE THE STATE RULE FOR <br />LOCALLY ENFORCED MOTOR VEHICLE <br />IDLING LIMITATIONS AS PART OF THE <br />AUSTIN/ROUND ROCK MSA CLEAN AIR <br />ACTION PLAN FOR THE EARLY ACTION <br />COMPACT. <br /> <br />RECITALS: <br /> <br />1. The City entered into an Early Action Compact (EAC) with the U.S. <br />Environmental Protection Agency (EPA) and the Texas Commission on Environmental <br />Quality (TCEQ) and other local governments in the Austin/Round Rock Metropolitan <br />Statistical Area (the Region) in order to pro actively and effectively address the Region's <br />air quality issues. <br /> <br />2. The City has, with other communities in the Region, developed and approved <br />an EAC Clean Air Action Plan that consists of numerous state and locally-implemented <br />measures to improve the area's air quality. <br /> <br />3. The City committed to implement measures in the Clean Air Action Plan per <br />EAC requirements. <br /> <br />4. The TCEQ has incorporated the Clean Air Action Plan into the State <br />Implementation Plan (SIP), making the measures in the Clean Air Action Plan state and <br />federally enforceable. <br /> <br />5. One of the measures included in the Clean Air Action Plan and SIP is the state <br />rule for locally enforced motor vehicle idling limitations. <br /> <br />6. Implementation of the state rule for locally enforced motor vehicle idling <br />limitations requires local governments to enter into a Memorandum of Agreement <br />(MOA) with TCEQ for local implementation and enforcement ofthe rule. <br /> <br />7. Implementation of the state rule for locally enforced motor vehicle idling <br />limitations also requires local governments to submit a detailed implementation plan to <br />TCEQ. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />PART 1. The City of San Marcos approves the MOA and Implementation Plan <br />for the locally enforced motor vehicle idling limitation rules for submission to TCEQ. <br />
