<br />178. <br />Regular Meeting <br /> <br />August 16, 2005 <br /> <br />Page 12 <br /> <br />Principal Amounts and Purposes. Mr. Mihalkanin stated he is concerned with <br />relocating Municipal Court to the Police Department. He stated he feels <br />Municipal Court should be located in a neutral place. Mr. Mihalkanin moved <br />to remove Proposition No. 2 from the Bond package, and Mr. Taylor seconded <br />the motion. Mr. Taylor stated when someone is incarcerated they go to the <br />Hays County Jail. Mayor Narvaiz stated several Cities have their Municipal <br />Courts and Police Departments at the same location. Mr. Taylor withdrew <br />his second. Mr. Thomaides seconded the motion to remove Proposition No. 2 <br />from the Bond package. Mr. Thomaides then withdrew his second stating a <br />majority of the Council agreed to place this on the ballot. The motion to <br />remove Proposition No. 2 was not seconded and failed. Mr. Mihalkanin <br />moved to add wording to Exhibit A Precinct 315 (portion of City) <br />(City has designated a portion of Precinct 315 as Precinct 314 in past <br />elections. For this election, that portion of Precinct 314 is designated <br />as a portion of Precinct 315), and Mr. Thomaides seconded the motion, which <br />passed unanimously. The Council then voted unanimously for adoption of the <br />Ordinance on emergency. <br /> <br />Mayor Narvaiz introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />REPEALING SECTIONS 38.026 AND 38.027 OF THE CITY CODE AND AMENDING <br />SECTION 38.028 OF THE CITY CODE TO TRANSFER THE FIRE MARSHAL'S OFFICE <br />TO BE A DIVISION OF THE MARSHAL'S DEPARTMENT; AMENDING CHAPTER 62, <br />PUBLIC SAFETY OF THE CITY CODE TO CREATE THE MARSHAL'S DEPARTMENT, <br />WITH A FIRE MARSHAL DIVISION AND A CODE ENFORCEMENT DIVISION; <br />AUTHORIZING THE MARSHAL'S DEPARTMENT TO ENFORCE ALL CITY CODES AND <br />ORDINANCES; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Mr. Guerrero moved for approval of the Ordinance on first reading, and Mr. <br />Mihalkanin seconded the motion, which passed unanimously. <br /> <br />Mayor Narvaiz introduced a discussion regarding City Council direction on <br />future agenda items. 1) Mr. Mihalkanin stated he would like to have an <br />update on the Hotel/Conference Center. 2) Mayor Narvaiz stated if there is <br />a Resolution the Council would like to provide to the National League of <br />Cities, it needs to be sent to the City Clerk. The Council agreed by <br />consensus to send NLC the Do No Harm to Cities Resolution submitted to TML. <br /> <br />Mayor Narvaiz introduced continuing Executive Session pursuant to the <br />Government Code, Section 551.087, to discuss commercial or financial <br />information the City has received from a business prospect that the City <br />seeks to have locate, stay or expand in or near the City and with which the <br />City is conducting economic development negotiations, or to deliberate the <br />offer of a financial or other incentive to such a business prospect (North <br />
