<br />PART 1. The statements set out in the preamble to this resolution are adopted herein as if <br />fully set forth herein. <br />PART 2. The operation of the Proposed Rates by CenterPoint in the City is suspended <br />for a period of ninety days from the Proposed Effective Date. <br />PART 3. The City is authorized to form a coalition with other cities to review the <br />Proposed Rates, to be governed by a steering committee (the "Steering Committee") composed <br />of representatives designated by the governing bodies of the cities. The Steering Committee will <br />be authorized to hire and direct legal counsel and consultants, negotiate with CenterPoint, make <br />recommendations concerning the Proposed Rates, and direct any administrative proceedings or <br />litigation related to the Proposed Rates. <br />PART 4. The City Council hereby designates the City Manager, Dan O'Leary, as its <br />representative to the Steering Committee. <br />PART 5. The intervention and participation by the City in any proceeding related to the <br />Proposed Rates is authorized. <br />PART 6. Pursuant to Section 103.022 of the Texas Utilities Code, CenterPoint shall <br />promptly reimburse the City's reasonable expenses related to review of the Proposed Rates. <br />PART 7. The meeting at which this resolution was approved was in all things conducted <br />in compliance with the Texas Open Meetings Act, Chapter 551 of the Texas Government Code. <br />PART 8.
