193. RESOLUTION NO. 2005-....1-O..9..-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN INTERLOCAL AGREEMENT BETWEEN THE CITY AND THE SAN MARCOS CONSOLIDATED INDEPENDENT SCHOOL DISTRICT REGARDING CERTAIN BUILDING PROJECTS; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The School District is planning to construct the following new building projects (the "Building Projects") in the near future within the City limits of the City: A. New Bowie Elementary School located on a site off of State Highway 123 South in the new Cottonwood Creek Subdivision B. New Support Services Building located on a site in the 2500 block of Hunter Road 2. The City has enacted a Land Development Code (the "LDC") that includes regulations for developments such as the Building Projects, including exterior construction standards and landscaping requirements. 3. The School District's 2004 Bond program was prepared and budgeted for by the School District prior to the City's adoption of the LDC. The School District has not budgeted for the additional costs associated with the implementation of new requirements under the LDC. 4. The School District has presented design drawings to the City Council of the exterior appearance of the Building Projects. 5. The School District has requested that the City grant reliefto the School District from exterior construction standards and landscaping requirements for the Building Projects. 6. The City Council is willing to grant relief to the School District from exterior construction standards and landscaping requirements for the Building Projects to the extent described in the attached Agreement. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The attached Interlocal Agreement between the City and the School District regarding the Building Projects is approved.
