<br />193. <br /> <br />RESOLUTION NO. 2005-....1-O..9..-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING THE TERMS <br />AND CONDITIONS OF AN INTERLOCAL AGREEMENT <br />BETWEEN THE CITY AND THE SAN MARCOS <br />CONSOLIDATED INDEPENDENT SCHOOL DISTRICT <br />REGARDING CERTAIN BUILDING PROJECTS; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The School District is planning to construct the following new building projects (the <br />"Building Projects") in the near future within the City limits of the City: <br />A. New Bowie Elementary School located on a site off of State Highway 123 <br />South in the new Cottonwood Creek Subdivision <br />B. New Support Services Building located on a site in the 2500 block of Hunter <br />Road <br /> <br />2. The City has enacted a Land Development Code (the "LDC") that includes <br />regulations for developments such as the Building Projects, including exterior construction <br />standards and landscaping requirements. <br /> <br />3. The School District's 2004 Bond program was prepared and budgeted for by the <br />School District prior to the City's adoption of the LDC. The School District has not budgeted <br />for the additional costs associated with the implementation of new requirements under the <br />LDC. <br /> <br />4. The School District has presented design drawings to the City Council of the <br />exterior appearance of the Building Projects. <br /> <br />5. The School District has requested that the City grant reliefto the School District <br />from exterior construction standards and landscaping requirements for the Building Projects. <br /> <br />6. The City Council is willing to grant relief to the School District from exterior <br />construction standards and landscaping requirements for the Building Projects to the extent <br />described in the attached Agreement. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The attached Interlocal Agreement between the City and the School District <br />regarding the Building Projects is approved. <br />
