<br />194. <br /> <br />Interlocal Agreement between City of San Marcos and <br />San Marcos Consolidated Independent School District <br />New Bowie Elementary School and Support Services Building Projects <br /> <br />Effective Date: <br /> <br />August 17, 2005 <br /> <br />Parties: This agreement is between the City of San Marcos (the "City") and the San <br />Marcos Consolidated Independent School District (the "School District"). <br /> <br />RECITALS <br /> <br />1. The School District is planning to construct the following new building projects (the <br />"Building Projects") in the near future within the City limits of the City: <br />a. New Bowie Elementary School located on a site off of State Highway 123 <br />South in the new Cottonwood Creek Subdivision <br />b. New Support Services Building located on a site in the 2500 block of Hunter <br />Road <br />2. The City has enacted a Land Development Code (the "LDC") that includes <br />regulations for developments such as the Building Projects, including exterior <br />construction standards and landscaping requirements. <br />3. The School District's 2004 Bond program was prepared and budgeted for by the <br />School District prior to the City's adoption of the LDC. The School District has not <br />budgeted for the additional costs associated with the implementation of new <br />requirements under the LDC. <br />4. The School District has presented design drawings to the City Council of the exterior <br />appearance of the Building Projects. <br />5. The School District has requested that the City grant relief to the School District from <br />exterior construction standards and landscaping requirements for the Building <br />Projects. <br />6. The City Council is willing to grant relief to the School District from exterior <br />construction standards and landscaping requirements for the Building Projects to the <br />extent described in this Agreement. <br /> <br />AGREEMENT <br /> <br />In consideration of the mutual covenants contained in this Agreement, the City <br />and the School District agree as follows: <br /> <br />Section 1. Building Exterior Materials and Articulation <br /> <br />The City agrees to allow metal sheet panels, insulated plaster coating systems and <br />concrete as permitted exterior wall materials in all of the Building Projects, without <br />requiring the School District to secure a Conditional Use Permit. The City further agrees to <br />allow the School District to construct all of the Building Projects without complying with <br />the Building Articulation requirements of the LDC.
